I think the i485 from vawa works with visa availability so yes you just have to wait it’s also a 6months -2 years wait for your green card after the 2 years it took for your vawa to be approved unfortunately.

I’m not 100% sure either that’s just what I’ve heard.

if the vawa is approved they send the c31 work permit

but they’re 2 types of work permit u can apply for the c09 which comes with you apply for the I485 which comes sooner then the c31 which comes after the vawa is approved only

did u apply for the i765? or u only applied for the i360?

u will only get it if you applied for a work permit. I think not sure. did u receive an approval letter?

i applied for for the vawa which was approved march i applied for i-765 and i-485 and did biometrics march 19 2021 and still haven't hear anything back

that’s why if you had applied for your i765 same time as your vawa then you would’ve been approved but you have to wait the 8-11 months that’s on the i765 processing time. since you just filed it in March so that’s a new application so u still have to wait.

Ohok so u didn’t get the c31 card cause u didn’t apply for the work permit. not sure if there’s something on the Vawa form itself that u have to check and receive the card but idk

I’m inpatient. I filed everything (i130, i765 & i485) back in Jan 2018. i130 got converted to i360 in 2019. I just want to know when does the i485 get processed. I tried asking my atty on Monday, but she was acting like she was getting turned around with info & wasn’t sure of her info.

My atty said, when they request the RFE for the medicals, that’s a sign your interview has been waived & you’ll receive the GC in the mail. Time will tell. I seriously can’t believe that they paused for the holidays. That’s just rude! Ppl have been waiting for so long, then the pandemic hit, now you lot have put processing on pause? A bunch of bums! 😂

liza I was saying the same exact thing. Why make it sooooo difficult for ppl to get their papers? To me, it makes more sense to go ahead & give ppl their documents so they can become productive contributors to society. The way they drag their heels will make you consider packing your bags & going back to wherever you came from! I seriously don’t see how they can go on holidays at a time like this…..but then again they probably have the attitude of, they’ve been waiting this long…..they can wait a bit more! 😈

@k p don’t you need to submit another i485 when you switched from i130 to i360? my friend submitted another one. and she also received letter from uscis saying the 1st i485 which was based on the i130 is no longer valid.

When I asked her again about it last week, she couldn’t give me a straight answer, so I’m taking things into my own hands & doing my own research. I can’t seem to find a straight answer anywhere. PP I ~ I’ve been searching through previous posts on here & it’s a mixed bag. Some ppl kept original i485 filing & had it held in abeyance. I read where some got notification 1 month after Vawa approval that i485 was transferred to NBC. Other posts stated they withdrew their i485 (or ex did) & they filed a 2nd i485 along with i360. @kp could your case be taken as a withdrawal, given you went in and mentioned you’re switching, also would it be safe to go ahead and submit a new i485 maybe with copy of the old one and a waiver of payment.

PP ~ idk, that’s why I’m taking matters into my own hands. My atty is all over the place. Instead of dealing w/what’s in front of her, she’s telling me she’s on a committee for Vawa. HOW? You can’t even handle the Vawa case that’s in front of you now! I asked her about the I485 last week when I picked my EAD up from her & she said she wasn’t sure. I always leave sick to my stomach when I have to deal w/her coz her attitude is so blaze’ & she NEVER gives me straight answers. The good thing is, I finally have an EAD. I can put money aside for a new atty if it comes down to it. In the meantime, I keep checking my local office to see if I can get an info pass, but tbh, I’m not sure if they’d have the answers….maybe it’s NBC who I need to be tackling about this matter, as THAT’S where they come from right?

PP I ~ I was just thinking…….if the I485 was truly withdrawn, would it STILL provide info on USCIS’ website. It states interview was completed & case must be reviewed. Let me see something. I’m going to see if there’s any info on the i130.

PP I ~ Okay the I130 info is basically the same. No info on it being withdrawn or anything, but what I did do, was read the Vawa approval notice: You will be notified separately when a decision is reached on your pending adjustment of status application. So they DO have my initial I485 application. Fingers crossed that the decision is made sooner than later. I feel better now.
