USCIS response to Congressman RIDICULOUS
This is what the congressman’s office received as a response about my USC spouse’s inquiry into out standalone i-130 pending over 19 months:
USCIS service records indicate your constituent's Form I-130 was received on January 19, 2024. The case is under the jurisdiction of the XXX field office and is currently pending review and possible interview scheduling. The current processing time for stand-alone I-130 petitions for all field offices is approximately 68.5 months. The petition is within normal processing time. Once the case has been reviewed, the constituent will receive a notice of action or decision at the address on file. We are unable to determine when the case will be reviewed and adjudicated. Please inform the constituent to keep their address current with USCIS. If your constituent moves, they must submit a Form AR-11, Change of Address. For more information about address changes, please visit our Web site at https://www.uscis.gov/addresschange, and click on "Change Your Address Online."

First of all, we filed in February 2024 so I don’t understand where they got January from.
Receipt says Texas Service Center. I assume they CAN transfer it to field office… but 68.5 months???
We are not going through consular processing, as I am here living in the US with my spouse. I have an old pending court case for asylum through my previous spouse which was since separated and transferred to my new state’s court (10+ years pending), which can complicate things, but this all seems so off. I understand they can say and do whatever they want without any reason…
Anybody else in this/similar situation?
I have a lawyer who is also unable to say/do anything.
I guess i’m glad my court case is not moving since at least i’m not being ordered removed, but this waiting is just too much.

when you say asylum pending? Is it at the board of immigration Appeal?

it’s with EOIR. only had 1 master hearing back in 2018, then individual hearing canceled due to covid and then divorced and separated case. no hearing since. so it’s just pending in court

it's only been a year!! These cases take a long time. Be patient

it was a year in February. now 19 months. PD 2/23/24
spouses of US citizens (even those who were illegal overstays) have gotten greencards in 12-18 months…
