URGENT HELPPPP
Hi guys, I have a friend who is in deportation proceedings but about to get married in a week to a greencard holder. So the question is, can the wife file for her without problems and what will be needed?? Thank you communication

@Yas I Residents can also apply for their spouses. I would strongly suggest getting an attorney and stopping/cancelling the deportation orders first. Once that case is closed then they can apply.

@Yas I Like I said, remove the deportation proceeding. They can apply for i-130, wait for visa bulletin to be current. Again, the point is it's possible to apply for green card while the petitioner is only LPR.

Hey Joyce, Same case here. He should marry her now and file her documents. Don't activate the case temporarily. Once she applies to cancel deportation, they can wait for his citizenship and then activate the case.

These guys should go and seek the assistance of immigration attorneys. They can interpret the immigration systems. Overstaying is a breach of immigration system and only a citizen spouse can do the real job! Good luck!

Normal she would have to leave the country for consular processing if married to a green card holder. She would also need a waiver before she leaves so that she's able to come back. But since she's in deportation proceeding best talk to a lawyer. Look for The Gilman Immigration Law Firm (612) 261-0086 and give them a call. Very good lawyer.

@Yas I not true at all im under deportation my husband is a permanent resident as long as you get court case TERMINATED permanent resident can petition DONT SCARE PEOPLE WITHOUT FULLY KNOWING

attorney should apply to have court case terminated only when you have I-130 approved removal proceedings take years i have been in this process for 10 years with a work permit its just mores steps to do but not impossible you will need to ask for the forgiveness and they will look into the marriage alot more and in detail also this will be a very expensive process but like i said not an impossible one good luck

is the green card 4 years on the status? if yes, they can continue, however, if the person has no criminal record, and has been involved in any other activities, a good lawyer, can request a stay action from court while looking a good channel, to fight is stay in the US. Ultimately, with intensed prayer, God will answer his prayer if he believes.

there are several ways he can survive this situation, pls note, get a good lawyer, while he's here, to fight, consular processing is not a good option, ten they may not open his case, once you are violations they system has a way of punishing you, he Must fight to stay. go get an attorney to file for stay action, on his deportation. they will alway find ground to get court order.
