urgent help, getting overwhelmed
Hello everyone,
I had my EB-2 NIW approved late last year and decided to apply for EB-1 Extra Ability this year. My application was submitted in January 2024 without premium processing. On July 27, I opted for premium processing, and on August 2, I received an RFE addressing criteria 2, 5, and 6. I have since added additional evidence to address criteria 4.
I have completed my medical exams, and my I-485, I-131, and I-765 forms are ready for submission. However, I have a few questions:
1. Since EB-1 is current, can I submit my RFE response and my Adjustment of Status application at the same time, or should I wait for my I-140 approval?
2. I was informed that if my I-140 is denied, I will not receive a refund for my Adjustment of Status, EAD, or Parole fees.
3. My husband has been out of work for two years. What options do we have in this situation?
I would appreciate any advice, as I am feeling quite overwhelmed.

1. wait until you get the decision for I-140. for PP, its usually within 4-7 days.
3. since you may have met at least 2-3 criteria for Eb-1A, try applyin for O-1A. you can easily get this approved since the adjudication bar is very low and approval is almost 90% this year esp for California Service Center
