I recommend don't and remember re-entry is not guaranteed with AP. Rest is your choice.

Did you know someone that no re-entry with AP?

They will take you to the CBP office, holding your passport, they will ask you the same questions many times… I hope you survive this! They will ask you if you ever stay in the US without or with expired status and if you ever work without work authorization… What was the motive of your trip, if you are employed/for how long… These are many questions you could have to answer before they parole you for one year. I’ve been through this two weeks ago after a trip from Mexico to Chicago, for one moment I thought they wouldn’t let me in. Good luck 🍀

Depends on where are you going. While WITHIN the US, it is 'fine' to have an expired Visa if you submitted the renewal request. If you plan on traveling abroad, DO NOT do so without a Valid Visa accompanied of a Valid AP. If you choose to do so, it is very likely you'll NOT be allowed to re-enter. Best, F

Expired F1? so what’s your status now?

what if they ask you about your expired visa on your passport? I am not trying to scare you but most of the officer at Port of Entry checks for validate Visa. So, how are you going to convince them about visa and status for the re-entry? This fear was unlocked in the past inside my head. Don't take a chance. As long as you are inside the States, no one is coming to interrogate you about your details. Just hold on, have a faith my friend. A lot of people along with me are still living in a dream to travel back home. But don't put yourself in trouble. It's 50-50 chances to re-enter the United States.

I have my parole too since last year September. but am afraid to use it.is better for me to wait until I have the GC first.

I don't intend to scare anyone here. My friend went through hell using his AP. He was taken to secondary room kept there for hours. Asked about his detailed previous status. tuition fees payments. Luckily he pulled it. But not everyone can be stable to answer during that particular moment. Goodluck!

@Likes F I said visa expired. I still have my status, but my visa already expired. My wife went visit her family and she came back with no problem, but she is the F2. I would like to know if any F1 have tried that. I know with AP we don’t need have a valid visa, because this document is one exempt for visas. my question is I need request authorization in my I20 or I need proof I’m vacation. @EB3 UNSKILLED 2021 going to the secondary room is basically mandatory, they will always check a second time.

@EB -3 Seen people going outside US and coming without any problem. because that’s the purpose of AP to allow you to re-enter US. They will definitely take you to separate room for interrogation but if nothing illegal done like unauthorized work in social security, unauthorized stay then should be fine I guess. anyway talk to your attorney before you make a decision.

@EB -3 going in and out of US with F1 visa is possible if you applied your F1 in your home country. if you are waiting for your GC and F1 visa already expired, what’s your current visa?

@Likes F It is still student. visa and status is two thing completely different. I can have a expired visa but still keep my status.

@EB -3 Doesn’t make sense to me. How can you keep your status if your F1 visa is expired . Can you please explain it further? I’m on the same boat. My OPT got expired last 2/28, got the approval of my I-140 last 3/3 and waiting for I-485 approval. I was advised by my lawyer to keep my status and never keep my visa from expiring.

@Likes F you can have expired visa in your passport but you should have unexpired i20. as long as you are studying and have maintained your f1 status you are authorized to stay as legal regardless of your f1 visa stamp date in your passport

my experience. I had f1 status. I was an opt applied for eb3 and got AP. I travelled in January. I had no issues coming back and they asked no question but they did take my passport and did their checks. Each case is different, it’s a 50:50 chance

@Kedra K Did they check only your AP? dDid they ask for you I20? Where was your port of entry?

they took my passport and asked for my AP. what they checked in their system, I don’t know. they didn’t ask for I20, but I had it on me just in case. As a matter of fact, I had all my uscis documents just in case

I was there maybe 20-30 mins. but there were ppl before me. as I said everyone’s experience will be different. I’ve seen some saying it took 10 mins. there is no specific time frame

I was talking with my lawyer and he said in 20 year he never experienced someone denied to ré-entry will AP

I have my AP too but i am so worried to travel to my country with that but most likely i will go because my pd is not still current for green card …

@EB -3 , I traveled to my home country for Christmas. spent 45 days there. My F1 was expired, had only the AP. My return was so smooth! They didn’t ask anything! Just checked my document. It took about 5 minutes.
