Travel overseas with L1A (while AOS pending) ???
Hi friends, I’m currently on L1A visa and in process of Adjustment of status and I’m scheduled to travel for business conference next month on May for 5 days, my L1A visa I94 is expiring on September this year.. ( also my AOS is processing the i140 and i485 is pending) is there any problem or things to worry about or it should be fine? .. anyone with similar situation any advise will be greatly appreciated.🙏🙏

you should be fine. I’ve done it . no issue on your I-485 , just make sure when you’re back you’re admitted under the right visa on your I-94.

same situation, presuming you also applied for advance parole and ead? my lawyer told me not to travel until L1 is renewed or advance parole is received. got rfe for l1 so awaiting, they told me since uscis will cancel my advance parole and I will be out of status in Oct if my l1 extension doesn’t go through or my advance parole isn’t approved by then. by staying, I have 2 options I could secure in case one of them fails, by traveling I will be left with just l1 extension and looking at the rfe evidence requested, seems scarier than usual.

I traveled with L1 while I-485 was pending, no advanced parole at that time - I filed for it when I returned in the USA. You’re fine

travelled on L1a many times for work, while pending Aos, without advance parole, no issues at all. but my l1 was valid until 2026, never had to renew. so you should be good if your l1 is not expired yet. my lawyer never filed for advance parole because l1 was enough, and aos was approved before l1 expiry.

I traveled on L1 with my family (L2) many times during AOS pending and AP not approved without any issues. Last time we entered US 2.5 months before my visa expiration date, also without issues.

@Alice h sorry for confusion. you can 100% travel, but your advanced parole application is going to be cancelled if it’s still pending. scenario I am referring to is (hope not) your l1 extension is rejected, now you won’t have l1 nor advance parole to travel abroad come September.

@Ann Voig when my lower filed me the AOS it was ( i140, i458, i131, i765) my EAd approved but still the advance parole and i140 and I485 and i131 still under process, they filed on July 2024 under regular, I just upgraded my i140 to premium last month so hopefully I see some movement in my i140 and further on i485, but with all this happen, my managment asked me to do this overseas trip next month to South America for business conference and I’m so sorry leaving the country with all these stories of CBP problems with expats

@Fried Cauliflower you can travel. I just traveled to Brazil and returned to the US using my advance parole. just expect to be sent to secondary screening, it’s all part of the process because they need to manually verify the documents.

@Ann Voig but I don’t have advance parole I have only L1A status my AP is still under process so I presume it should be fine
