Tourist requesting Parole
Hi, I want to know if a person who entered to USA with Tourist Visa can request a Parole to stay for a long time to take care of his mother resident, as she doesn’t have anyone to take care of her, she got Bladder Cancer grade 4 and she is taking treatment in a hospital, let me know please if there is a way her son can request a parole to stay in USA even the 6 months of the Tourist Visa expire…Thank you in advance if you can help…

you can apply for extension of your tourist visa. you can apply online the application is I-539

But my point is: when I return to my country and come back again months or years later, they will ask me at the port of entry, why I lasted a lot of time… I would like to have a Parole issued by the immigration department, that way I can justify why I lasted a lot of time…

as far as I know, there is no parole that can be issued for non immigrant visas. and if you overstayed already in the US beyond your allowed time, you are risking you will not be allowed in the US in future visits, so if you didn’t overstay go ahead and apply for an extension, and submit all the supporting documents to back up your request.

if you apply for an extension, it won’t be a problem in the future as long as you will not overstay illegally. you have a valid point, filing extension is legal and won’t affect your future visit.

your mother is a resident here or citizen? why not file for petition and adjust status legally.

She is resident and she sudmited a petition for me 1 year ago, adjusting status is what we desire, but we are not sure if possible because I think I have to wait the processing time in my case is 5 years it takes.

According your experience and knowledge, do you think is possible and did you see a similar case like mine?… Resident Parents already submitted a petition years ago and sons enter to USA with Tourist Visa and adjust status legally within the states?… in this case is a special case because of a chronic illness…

you can definitely adjust status while your tourist visa is still valid. i am not really sure, I entered as tourist also here and adjusted status before tourist visa expiration (my wife petitioned me). i am not sure with your case. better consult an immigration lawyer, they can answer all your questions. from which country r u?

You have a valid reason, you can make an expedite request for the your petition.

Ok, you entered as tourist and adjusted status with your wife, that’s possible if she were citizen at that moment, my case is different, your category was F1 mine is F2B, Resident Parents sudmiting petition for single son older than 21 years old, anyway yes, I have to contact a lower about the expedite request, I think that is make sense in my case… I’m from Dominican Republic…

Ah ok, my mistake, you’re F2A, you’re right, F1 is for children of citizen parents…what I am sure is: if my case were at National Visa Center, I can to request an expedite, but my case is in USCIS and it’s not aproved yet because of the time it takes these kind of cases.

Hi, I spoke with an immigration lawyer and he told me it cannot possible in my case, I cannot do a status adjustment because there isn’t a Visa available for me…
