@Jhoe 🇳🇬 do you work at USCIS so how do you know it’s been denied. it’s better to speak words of encouragement rather than just negative words. The whole process is draining and mentally exhausting and the best we can do for each other on this platform is to encourage each other. Thanks.

@mount laurel New Jersey yes tier 2, I called and say info pass appointment them I spoke to a regular officer and requested to speak to a tier 2. this was 2.5 years ago but it's worth a try..I thought they'd have least given you a work permit. Also, if you have an online account. please check it thoroughly. good luck 👍

@bri flan I check almost daily. I always speak to a regular info specialist they aren’t even officers and request for a tier 2 but they never transfer it’s always they make an appt and then never call back like they say they will. did they transfer you or they called back?

oh so maybe it pushed them to look at your case and approve it. it’s been awhile since I asked for a tier 2 but maybe it’s worth another shot

I m waiting from Aug 2022 but I got my EAD June 2023 and I m working now and waiting for my approval almost 18 months running

maybe I can ask Emma to request a tier 2 as well

would I want it regarding my 130 or my 485

am 2021 Sept I call them In October and they gave me 90 days after the 90 days I call back they gave me 30 more day last week I got an email saying I should reach of to them in 6 months time,what I can I do it's already pass processing time

You did not get EAD I-765 or Advance Parole I-131 approved because these 2 benefits are based on I-485, application to adjust status, and, as per uscis response to you in June 2023, the underlying i-485 must be reviewed and deemed prima facie eligible. it means that the submitted application must appear "at first glance" eligible for adjudication and potential approval. But right now it does not. why? because i-485 is actually based on i-130, petition for alien relative. You have AWA case and you know that Adam Walsh Act imposes immigration penalties on us citizens who have been convicted of certain “specified offenses against a minor”, they may not file petitions for alien relatives. in order to petition for foreign spouses, such petitioners must obtain AWA waiver, read here for more details https://gillinlaw.com/adam-walsh-act-waivers/#:~:text=Adam%20Walsh%20Act%20and%20Family%2DBased%20Visa%20Petitions&text=Due%20to%20the%20enactment%20of,a%20family%20member%20or%20fianc%C3%A9. You need to concentrate your efforts on getting approval for I-130; all other applications are based on this petition. While you are deciding whether to file writ of mandamus lawsuit, you can try to submit inquiries again, but for I-130 as this is the basis of you case. You know, the usual outside of processing time service request, ombudsman, congressional inquiry, you can try to schedule infopass appointment, I doubt they will give it to you but you will have a chance to speak to tier 2 officer and ask him/her questions about your case. I think you wrote somewhere that your petitioner's criminal case is ongoing, like there is no final disposition yet? maybe uscis is waiting to see how it ends?

@mount laurel New Jersey really hoping and praying you get some positive update very very soon. The wait can be frustrating and draining but don’t give up hope. Try calling everyday and contact the Ombudsman to submit an expedite request on your behalf.

yes I know all that @Ice Cream but I never got an noid which is when the waiver comes into play and I know people who are awa case and they got ead and rfe and never got noid and never needed a waiver

I also haven’t been convicted only arrested and my case is pending so maybe they don’t know what to do with it

@mount laurel New Jersey it is good that you know all this already. I am guessing (and I am a nobody, just another uscis applicant) that uscis thinks that your case does not meet eligibility requirements "at first glance" as of right now and so there is this significant delay in processing.

correct I believe that’s the reason for the delay. uscis inquiry tells me caseload factors not related to your case and congressman inquiry tells me security checks

and my expedite request was denied cause of not having prima facie

I’ve looked into hiring Allan s Lolly who handles these cases but there isn’t much they can do since I haven’t gotten noid

i want to reiterate my point about I-130. if I were you, I would concentrate on getting approval for I-130. so submit all kinds of inquiries for I-130 specifically. do congressional inquiry for I-130, mention intent to file writ of mandamus, hopefully it gets things moving in the right direction.

@Ice Cream I did senator inquiry and mentioned intent of writ of mandamus, but the reply was just like generic reply. my inquiry was for I-765 and 485 though.
