Stop working EB3 unskilled
Hi Guys, I want to share my situation and ask for opinions. I received my GC 1 year ago. I have been working for my sponsor for 7 months. I gave them a 2 weeks notice letter saying I was going to stop working in 2 weeks as everyone told me there was no problem. However, the agency and the sponsor are threatening me. The agency sent me a fraud letter directed to the immigration fraud department saying that I did not have good faith and that I used the eb3 program only to get the GC, only because I worked 7 months, not 12. The letter is signed by my sponsor . In the letter they ask for the withdrawal my i140. Is anyone going through this too? What to do? am I at risk?

@P Laksmi what is the state of your sponsor company? this letter is a lie, no worries and be happy when you leave, your GC has no restrictions you can leave anytime, even if you have already worked 7 months. You will have no issues.

who gave you this type of stupid advice. you can stop working if your sponsor allows . don’t take your GC for granted. immediately talk with your sponsor and apologize. then work for them .

they can’t withdraw your I-140 since it was already executed to get the greencard. Unless you signed a contract saying that you were going to work there for 12months there is not much they can do. And even if you do they can only sue you for breach of contract and that is nothing to do with immigration. You should ask a lawyer but I don’t think you have a problem with leaving them.

there won’t be any problem but why not work for 1 year as per contract if you don’t have any bad working environment. you got GC saying you will work for 1 year so if everything is good then just fulfill the contract and leave

You should be good. A permanent resident can switch jobs at will. Since you became a PR before jumping ship, they have got nothing on you. It would have only been problematic if you haven't gotten a GC. I would get a lawyer regardless.

You got your GC... nothing BDV or any other agent can do to you
You paid that loads of money while the employer signing a fake letter did not pay a dime but wants to hold you down to some slave contract?
BDV and whoever the employer is can't do nothing... it's bad business for them if they try
They know... so they will try to scare you... that's all they have

@X Y no I am not. i am also a client. just saying we all do contract for 1 year. so isn’t that a breach of contract ? if there is no good working environment then anyone must leave that job but if everything is good then just fulfilling a contract might help rather than landing in this situation. but i will ask @P Laksmi to talk to attorney

An employment relationship in the United States is presumed to be “at-will,” i.e., terminable by either party, with or without cause or notice

You sign the agreement which is not legally binding, its different than the contract which is legally biding. agencies are finding the way to make you looks good under bad employers and follow up sale

you should contact the labor department of your local jurisdiction to file a complaint if they continue threatening and retaliate against you

one thing I know that your employer and agency will face serious consequences for retaliation acts if you hire an employment attorney sueing them. they are in a deep trouble if they actually do that
