starting mandamus
got tired of waiting. it's passed 40 months now and there's no guarantee that they will revive my case when it's 46 months.even no rfe. now my lawyer preparing docs for mandamus. Got nothing to lose. 3.5-4k$ will be total charge.

you cannot file mamdamus unless you are outside processing times. as of now you are well within the tame frame. dont rush things. as of now I noticed a huge speed up of cases many approvals for March April and even June has some already. sit tight and get yourself busy I know the frustration im still pending too and im march 2022

to soon for a mandamus. the procesing time is 46.5 month, be patient as everybody. after 46.5 you are approve nor denied then do something. if you do it before may not work the answer will be wait contact again after 46.5 month

also i f give the advise to get an attorney. if you get denied, you will not know how to appeal in 10 days. they are giving only 10 to appeal.

I filed mandamus a few months ago, it was denied because it was not yet processing time. I was told to refile when it’s outside it. if you have the money fine! it doesn’t hurt to try. also I filed it myself, no attorney and tbh I didn’t attend to it because I traveled for months outside the United States after filing😂

@cris tina I was reading your reply that Mandamus can only be filed after the processing time, Someone misinformed you. I filed the mandamus two weeks ago and have already received a call from the federal district attorney’s office , who is currently working with USCIS on my case. I am at 41 months. Let’s say they deny, which rarely happens. I can re-file the case for $405 the very next month. They are required to respond to the judge every time I file a mandamus lawsuit.

@oct 2022 , quick advice from my experience. If your case is also October 2022, you should seriously consider filing a mandamus lawsuit. Don’t Listen to anyone on this chat. You can do it pro se (yourself) without a lawyer. The filing fee in federal court is about $405. Just file a Mandamus Complaint in U.S. District Court against USCIS, DHS Secretary, USCIS Director, and the Attorney General asking the court to compel USCIS to make a decision. If you have both I-360 and I-485 pending, include both applications in the complaint so the judge orders them to adjudicate everything. After filing, the clerk issues summons, and you just mail them by certified mail to the U.S. Attorney, Attorney General in DC, and USCIS/DHS. Once served, the government usually has 60 days to respond, and many cases move before that. It’s not as complicated as it sounds — the main cost is just the $405 filing fee and certified mail.

@A T yes I was denied and filed the mandamus before then. it’s not showing on my profile. I filed the mandamus late 2024 like November/ December I think but I was out of the country for like 5months after and didn’t attend to my he district attorney but they fought me for it stating that it’s still within processing time and to refile but they kept increasing it. it cost me like $500 to do it. the expedite was few months ago and it was denied too but my senator office is following up every 3months. ima just wait at this point. they are already attending to 2022 and I can see some from my months too. hopin to gets a good decision this year

@jj jj I know that a writ of mandamus can be filed about 5 months before the processing time. Since I am close to that timeframe, they will consider it. A few people I know who filed for Mandamus had success with it. Good thing is that district attorney reached out to me and said he's working with USCIS in regards to my case.
