spouse did not file tax for 2022
Hey everyone! I’m a green card holder through marriage, I’m eligible to apply for naturalization on march 2024. I’m trying to apply with 3 years rule ( marriage to us citizen) however, my husband and I had to file tax separately in past two years due to the fact him having problem with his company and can’t file on time. Now, this has been a problem to me because I believe I have to show my husband tax to uscis as well, and he is not filling his 2022 tax… should I wait for him to file his amended tax for 2022 and new tax on 2023, or should I wait for 5 year and just apply myself? Him filing tax late is a mistake, I’m not sure if that is going to affect me for my natulization or not. will uscis see he file tax late and use it against me? Please advise.

The fact that your husband did not file taxes does not affect your status. You are married to a citizen and you filed your taxes. These are 2 separate issues. You should proceed to file you naturalization application. Good luck.
