spillover from ROW
if there are visas available from ROW do they get assigned to backlog countries in the new fiscal year or will they again get distributed as per country limit. What are the chances of the spillover going to India EB1 category?

they did it during the fiscal year. recent forward movement is because of that.

@Regular guy @RW BM @h m All visas of this year is used up. Even there is no spillover from Family based nunbers. I do not think there will be extrodinary forward movemebt normally which happens during octover bulletin

I see your points folks but it’s intriguing that ROW is current in Sep bulletin and that means there are some available in that category. so if that’s the case then the question is, can they be allotted to India?

@Regular guy @RW BM @G L @h m USCIS year ends with September but we didn't see any movement for indian that means no spillover. from October onwards uscis will be utilizing next year quota.

@Atharv A well if that’s is the case then can’t see the dates moving significantly. Infact it will be quite the opposite, maybe a movement by a couple of months at best for Eb1 india, I presume. Actually likely that the whole of next fiscal year will see a movement by maximum of 4 - 5 months 😞I hope I am proved wrong

@Regular guy in my opinion uscis should open at least 2 quarters or more because most of the cases in 2020/21 cleared before retrogression and now they are working on ported cases from EB3 as their PD won't change after the conversion.

Every FY, EB1 India gets around 10-12k numbers in total (3k by default allocation and remaining spillovers from ROW). So FAD is expected to move to 2023 at least by end of next FY. Qualifying for EB1A or EB1C is difficult and takes time. I expect less number of porting cases blocking date movement to 2023.

@spv c that’s a very useful input. but I do have a question. if EB1 india gets 10-12k every year, how is that only 5k visas are awarded every year, especially in the last 3-4 years, the maximum given out in a year is 6.5k in 2021?

why there are too many indians in the greencard category ? i think USCIS needs to give the same conditions to every country. If you are not an Indian, it is getting hard to find a job especially in engineering field. This is not fair at all.
