senator experience?
Hello.
We are doing EB2-NIW and 140 was already approved.
My 485 was denied due to not responding to RFE. However, we did respond to it.
So we filed motion to reopen and attached all the evidence that we responded on time, however the motion was dismissed either.
RFE was from not my Local field office.
We are going to refile i-485 under 245k rule very soon. However, I want to know if I should try contacting to Senator or try ombudsman with our current dismissed motion to reopen and ask for inquiry and asking for help to resolve this.
My only worry about this is if this will affect my new i-485.
Does anyone know if contacting to Senator will affect our newly filed AOS in bad way?
And also should I also inquire Ombudsman?
Or
Does anyone has similar experience local field office denied your 485 with not responding to RFE? And if yes, how did you solve it?
Please help me.
I can’t believe this is happening.

I would suggest you refile asap with full evidence and your case should be processed really fast after that. I read one case similar previously. Senator will not help much in this sistuation. Just re file ASAP and can contact senator at the same time!

I am sorry it’s happening to you, hopefully things get resolved soon. Did the online portal ever showed “Response to RFE received”?

@Quickly Done what is your rfe about and are you on F1 or H1B. And what are the evidence you want to attach for the 245k rule.

Approaching Senator doesn’t have any negative impact on your case, IMHO. However, he probably won’t be able to assist you without active case at uscis
