RFE
Hi lawfully, has anyone received RFE from USCIS requesting for more evidence. The case was not physical abuse is based on emotional and psychological abuse and they're requesting for battered/ extreme cruelty or more strong evidence.
please, if you'd received such RFE your suggestion, concern and opinion is needed.

@Hifyberry ify this is where a psychological evaluation helps…. make sure you go to a psychologist who is well versed with immigration they use the same language that USCIS understands

@Hifyberry ify and you can ask your lawyer for a referral to a licensed psychologist who works with victims of abuse.

I had one in Baltimore back in 2020.
you can easily find only and book some sessions. one session is not good enough.
After they evaluate you and your trauma, they will come with a compelling reason on why you were hurt and how you much help you would need to get back up on your feet. They are an authority figure, so their evaluations matter

@Charlaprince princelachar NO OFENSE TO ANYONE, but do you really think psychological evaluation after getting RFE and after more than 3 years since petition was sent is a credible evidence? personally, I don’t think so. I would rather focus to gather other like more affidavits, maybe any old prescriptions, text messages etc. that’s my personal opinion only

@Hifyberry ify Write a detailed explanations of what happened to you and how you couldnt record any evidence of whatever happened then, notarize it and let whoever knows about it write one and notarize it and send to them

@survivor p . I didn’t notice the timeline. if the case has such time behind it, then you might just want to use other options. Detail the experiences you had and how you have been disadvantaged by the experiences. Make sure it corroborates the initial one you had submitted earlier.
Don’t mince with words when you want to write about the things that you suffered - even if they are sexual deprivation…

@survivor p : You really got it. I guessed the applicant didn’t have an Immigration Attorney. VAWA Application isn’t a joke. I had Police Report, Ambulance rushed me to an Hospital with Injury that bleeded, my Attorney told me to see Clinical Counsellor ( Psychologist) for their report and evaluation. Having a sound Immigration Attorney is imperative to VAWA application. @Hifyberry ify , I wish you good luck

I agree with @Charlaprince princelachar and @survivor p At this stage in the game you can't hire a psychologist. My case was not physical abuse either and I did not need a psychologists opinion to prove abuse. Thankfully my lawyer knew how to express what I needed to in a language immigration could understand. Often we mince words because we don't want to experience the trauma again but you have to lay it all out there and use the word 'abuse'. It has to come across that your spouse was abusive and not just a bad husband or wife so maybe you weren't compelling enough. Revise your personal statement and have others write some on your behalf if they knew about the abuse. If you don't have a lawyer, you might want to get one.

I filed my case Jan 2021 and I do have an attorney but i don't really like how he handles my case, very slow and not taking calls or calling back on time. I really appreciate everyone that contributed and I will respond accordingly.

@Hifyberry ify please get your self a forensic psychologist for evaluation, stop listening to this people. if your lawyer is not competent, get another lawyer.
there is no timeline for when you can use a forensic psychologist to ascertain if you where abused or not. also please read about forensic psychologist and understand their job. their job is to bring out the truth, help law enforcement agency to understand the mind of the petitioner if he or she is telling the truth.
