Rfe not received by USCIS
Pd: Current
Country: India
Eb1-B
Submitted medical rfe response to uscis in Sept 2023. Case status is still in "Rfe was sent".
Today after speaking with a emma agent found out that the Rfe was never recieved by Usics. My Rfe response window has now elapsed.
Does anyone have a clue what can be done?

Is it a medical RFE ? Do you have a signed proof of delivery document from FedEx or whichever sender you used ? Did you take a snap of the package with the address label of the sender when you shipped ? You can use all of these as proof that you sent it them.

talk to your lawyer with all the proofs.

It’s very difficult to know if they have received or not. Even if they receive it they don’t update sometimes is what I have heard. In my case, they sent RFE but the case status never showed that. Did you use FedEx priority overnight or UPS Express delivery or USPS express delivery?

when I spoke to uscis my case was at nbc
S SSJan 9, 2024
Did the RFE letter said to send to Albuquerque field office ? or nbc service center ?

After 60 days did you raise a service request to know what happened? did you get a response? if you have not got a response from then you can also use it as a proof that you did try to find out what went wrong.

rfe letter asked to send it to Albuquerque. opened 2 service requests but got no response. finally an emma agent told that there was no response received on the rfe they sent.

such a perplexing situation uscis created

@a g I worry these things all the times. But since you have raised a service request it is also a proof you can use. I have a feeling FedEx has perhaps delivered correctly and it is perhaps not their fault. If the address is proper it is highly unlikely FedEx will make a mistake.
