Return to US
My parents have US green card and they went to India in Feb 2023. They plan to return back on Jan 2024. They will return to ensure that the trip outside US is less than 1 year. Will they face any issues in immigration?

they're not supposed to be out of the US for longer than 6 months. They should have applied for a reentry permit before traveling

could you please provide link where this rule is mentioned? I have known about this rule: https://help.cbp.gov/s/article/Article-820?language=en_US

Beyond 6months can be a problem

That is for continuous residency for naturalization purpose which means if it’s beyond 6 months stay your 5 years wait to apply for citizenship gets reset. atleast that’s how I interpreted it

i interpert it to mean any “greencard holder”!

what.. they should have being back before 6 months. us will consider them abandoned of their green card. or something. green card holder can only stay up to 6 months. . u better get on that asap. good luck

I sought advice from immigration counsel and they mentioned it would reset their citizenship timing but will not harm LPR.

update: no questions asked. all went smoothly. The rule never said above 6 months. it says they should not stay over 1 year
