Retrogression
can someone please explain retrogression to me? I understand it to be that our I-485 won’t be approved until the date that’s current on the visa bulletin (so for F2A, roughly 2017). how come I see so many people in that category have approvals with more recent PDs? thanks!

I-130 can still be approved, I-485 cannot. Those people you see are probably thise who only got their I-130 approved

So if I go to, within this app, community/greencard/family-based filter on approvals, scroll through, there are some 2021 PDs approved I485 and even some 2023 PDs

@P V Retrogression happened in April 2023, they were probably approved before that.

@Zuzanna Q oh ok My attorney said it doesn’t affect me but idk im going to a immigration judge and terminating my court case and asking judge to approve my I-485

@Elsa Carvajal Hey - our lawyer responded that F2A isn’t retrogression and that the uscis is using the date for filing table and not final action dates table on the visa bulletin. this is consistent with the recently approved I-485s I’ve been seeing.

@P V retrogression does impact some family base case like IR petitioner, there is no cap on those visa they are limitless hence why those persons with 2023 PD getting approval before you. Because your in preference category visa class there is a limit to the numbers of these visa given out each year.

@pv don't know why your attorney telling you that but all preference category Visa class uses the final action date chart for approval of the I-485. However USCIS at time will tell you which charts they are using to accept application but to approve that application for a preference category it's always the final action chart. Talk with your attorney to get a better understanding of the process.

@hello mark Hey - thanks for sharing. I did press on her because what she said didn’t seem to line up with what the text on the visa bulletin read and she never responded to me. So now I’m less confident in her competence.

my experience with attorneys has been patchy at best. I have been given conflicting information and at times, I have been given entirely incorrect information. Dedicate some time into conducting your own research and don't be afraid to question your attorney if it doesn't seem to add up. That's my advice @P V

Thanks everyone - after one month, she sent this response. It kinda seems to make sense but I’m still hazy on this. Could you give me your opinions? thanks! I’m not sure if you have checked, but USCIS is using the Dates for Filing chart for family-based filings: Current Month’s Adjustment of Status Filing Charts For Family-Sponsored Filings: For all family-sponsored preference categories, you must use the Dates for Filing chart in the Department of State Visa Bulletin for September 2023. Based on the DFF chart for September 2023, the F2A category is showing that visa numbers are available to those who file on or before September 1, 2023. Since your priority date is 1/26/2023, you are not subject to visa retrogression

@P V I really don't think this is correct. I have done so much research and it all basically says, you are free to file the application (Date for filing), but they won't issue a green card until priority date is current (final action date). I hope you are right but I really don't think that is correct information 😞 Are you filing for green card spouse or citizen spouse?

@P V I don't know where you got this lawyer but he/she is confusing you. Yes according to your PD you are eligible to file the I-485,I-131,I-765 and renew them both until you get the green card. yes you are impacted but retrogression currently base on the September VB ,only person with PD before January 1,2018 are able to receive their GC for F2A ROW. read the statement in the VB"NOTE: Numbers are authorized for issuance only for applicants whose priority date is earlier than the final action date listed below.)"

@P V read the visa bulletin, you can show your attorney. The date of filing chart has nothing to do with issuance of your GC. filing chart for USCIS is used to accept I-485 and for the DOS it's used to assemble documents for applicants outside of the US to become DQ. Don't know if your attorney is unaware of how to read the bulletin or is intentional misleading you but it's concerning. For now you just waiting on become current on the final action chart to get the greencard or your spouse to become an Us citizen.
