you can apply for termination since you have your I130 approved already, what your lawyer said is not correct, motion to terminate goes to the judge first, once that is approved, then he can file motion to reopen, pls don't take my word for it, consult other lawyers, I'm not a lawyer and my opinion is not a legal advice.

@happy dino u can file “ MOTION TO REOPEN AND DISMISS/ TERMINATION”. so it just 1 combo motion. u don’t have to file 2 different motion. no need to wait for master calendar hearing. u can file tomorrow if u want but are u sure u want to use that lawyer ? what lawyer said is wrong. lawyer can reach out to DHS attorney to file joint motion, but if after few months dead silence, file directly to the court. good luck

@happy dino sometimes dhs attorney doesn’t agree with your lawyer to fill joint motion to court in that case your lawyer can just fill alone straight to court. Since your i-130 is approved. Dhs attorney would most likely agree to joint motion.

Because I feel she just file the terminate. She not file the letter for 1130 I think she just wanna make money. @mohmmed Salam! you lawyer is wrong. there is no other way to get that case terminated. Your lawyer should fill a joint motion with Dhs attorney agreeing on your motion. Dhs attorney doesn’t do joint motion unless you have approved i130 which you do. what termination reason your lawyer is putting on motion?

@domino 23 I just got a new lawyer . I have my I-130 approved. I want to terminate directly with the judge and my new lawyer need to submit motion to substitute counsel as my new lawyer. Can he file both motion together at once- motion. to substitute counsel and motion to terminate removal. Or does he need to file the motion one before the other?
