my spouse had an interview in NJ mid October, she is an arriving alien and has a removal order. still USCIS has jurisdiction over her and he’s able to adjust status. On Nov 2 we received an RFE for medical exam, it was recieved by uscis on nov 10, and we are still waiting for a Desicion. I guess they take longer because these type of cases are complex and the officer that interview is not the one whose going to Approve the application.

totally agreed, my lawyer advise me to wait we will get approved, I bring an updated medical as mine expired july 2021

do you have a i485 or i130? where she had the interview?

yes we submitted both I-130 and I-485, even though she has a removal order USCIS has to adjudicate her I-485 because they have jurisdiction over her “arriving alien” . and our interview was in Mount Laurel NJ

nothing yet… I recieved the I-130 approval letter but nothing on the I-485 it still say interview was scheduled

tell me about it, I have not get any approval but I have hope

my interview was in oct 2021, January 14 we will have 90 days since interview. I guess February 14 we will have 120 days. I sent an email contacting my senator trying to get him to do an inquiry but he hasn’t reply back. if anything after 120 days we don’t have an answer I’ll sue them. I will not by any means wait months and months without no purpose.

@klau i think you should call USCIS customer service and do an inquiry for the I-130 that’s what I did and since it’s probably outside normal processing time they will do a service request

Hi I was approved i-130 1/26 and i-485 1/25- received my green card, my lawyer sent a motion to uscis, they have to approved first, than it will go to the judge to dismissed the case

how it’s possible to get the green card before you close your other case with the immigration court and ICE?

well that’s how the law works… being in removal proceedings or having a removal order doesn’t always necessarily make you ineligible to obtain a green card. it’s more complicated but possible.
