removal proceedings
I consulted a lawyer concerning my removal proceedings case to see if he can help me file paperwork and to also represent me in court. he told me that I can file everything together meaning i130, i765, and i585 even though I'm in removal proceedings and wait to see if uscis will accept my application. is that even correct because I have spoken to people who's in the same boat they all say the only thing I can file for is the i130

I will advise to go with your attorneys advise, you will be saving a lot of time filing concurrently than filing only to adjust, speaking from experience

yea i know but my situation is different because I'm in deportation proceedings I have to go to court in February next year so because of that I can't file concurrently

I’m In removal proceeding too I file everything i485 i765 i130 i131 and they are working on my case I’m waiting for the interview and my suggestion you should file everything

it could be anything visa overstayed. problem with the law. asylum denied. any visa denied can put u in removal proceedings

I don’t have court date anymore that was 5 years ago now I’m adjusting my statu with uscis what you can do since you have a court date you can ask the court to terminate the process and you file everything with uscis or you will need a aprove 130 to do it in court

well your case was terminated so that means u can file with uscis. but when someone has a master calendar hearing which means they have not gone to court yet and wanna find out if they can file with uscis

you can only file i130 while you are in removal if you want to adjust through marriage Bc even if you file everything together with USCIS while you are in removal they can only work on your I-130 first then when that is approved you can either ask the judge to terminate your removal then you file with USCIS or you ask us USCIS to transfer your i485 to the judge then you can adjust in front of the judge. I was in removal process but I terminated it after my i130 was approved

I know all of that already cj because you told me and other people tell me too but my husband wanna do everything at once even though they only gonna work on the i130 and then after the approval of the i130 we can ask the judge to terminate and send the termination letter to uscis so they can proceed with the rest of the applications. not sure if that's a good idea and a lawyer told me the same thing today too so that's why I'm here asking because I know when u in removal proceedings u are not eligible to file concurrently

Hi, Jenn I think that your case needs to be evaluated by a professional CERTIFIED immigration lawyer. The case is rather difficulta and the wrong solution can cause some troubles... Hi @C J! I’am in removal proceedings too. I got married with my wife US citizen and we first filed for I-130 on December 2020 it hasn’t approved yet. 1) How long does it take for you to get your I-130 approved? 2) Once you got your i130 approved. How long does it take for the judge to terminate your removal proceedings? thanks!

@Bangui Seattle I applied for I-130 on 10/2018 and it was approved on 07/2020. so it took 21 months Then my lawyer file a motion to terminate my removal processing in 01/2021 and the judge terminated my removal processing on 04/2021.

@ marcten if you don’t have a court date it’s either you lost the case and the judge order you deported or the judge administrative closed your case. I don’t know if that answer your question because it’s not quite clear

the only way u can cancel is if u have an approved of a i130 or anything to show that u are eligible to stay in the country. u can consult an attorney for more details on that
