@Sandy Migrated I will take your advice and speak for myself. they had sent me a notice to appear and I didn’t get that notice because they didn’t put my apartment number on it so the mail was sent back to them saying incorrect mailing address but in that notice it seem as if my court date was February 26th. I have inform delivery so this is how I know what’s coming. they sent another mail out for me today the mail doesnt have my apartment number on it so I got ahead of it and went to the post office and when I open this mail it says I’m ordered remove because I didn’t slow up for my hearing. sandy this is serious.

nobody seem to be taking me seriously so I’m done wasting my time here. but for those who are serious there are videos on tic tok of lawyers speaking about their clients being placed in removal even though they have a case pending. I try to stay in the know. I saw those videos and I never thought that this would reach me because I have no criminal history but here I am today ordered removed.

If you have any benefit denied in the past, like marriage based application. then that was why you were placed in removal proceedings. You need to go appeal it immediately stating that you never received the first NTA and the reason was due to the government's error with yout address.

you should have checked the EOIR automated case information system, when you missed the first letter.

First of all, sorry for the surprising news. Second, when you applied Vawa were you in a legal status? Also for NTA, it may be a mistake, chances a low but it can be. So given that or assuming that when you filed Vawa you were in a legal status and are right now in a legal status then this can be fought out. A removal occurs when the benefit is denied and the individual does not have a legal status. Also if you have been in the country for over 10 years then you can file for COR, and considering your vawa is still pending that time reduces to 3 year and you can file Vawa COR.

@bugu5420 Robinson Yep, it's right. I was also put in removal proceedings and I have received an NTA. Still, my VAWA is pending, and reason was showing in NTA due to my overstayed visa. Also, the case is terminated by court until I get any decision on VAWA. They also denied my Advance Parole, while everything is done legally. The denial notice says now ICE will take custody for my Advance Parole. USCIS will not make any decision. Everything is messed up with USCIS, ICE, and us for unbelievable answers from USCIS.

that mean his case was denied in uscis. if you get denied you will get NTA. if hou do not show the the hearing in court you will prder deported. i believe you hou vawa case was denied already and the case is not apdate in the system. probably your case wasn’t credible enough that is tbe reason they sent you to fight your cade i. court.

@June 2022 I understand that this might be the reason, but they shouldn’t be able to deny you if you have proof beyond a reasonable doubt that you were being abused. I’ve submitted all that I could and they been sending me prima facey over 3 years. my current one expires in April of this year

@june filter 2023 you will not get advance parole if you do not have a legal status. And the case in the court how it got terminated? it will be on hold actually while the 360 decision comes. if 360 gets approved then it is taken to court and then they will terminate the case. I do not get it how come the NTA got terminated.

@Mein GanduI already had parole, but I filed again for renewal based on VAWA. Also, the court said it's terminated until I get a decision. Yes, I'm also getting confused and don't know what's going on.

prima facie does not mean anything. you can have unexpired prima facie and get deny. now days anythinn can happen

it can be true. they can put you in removing if you overstayed your visa. even if you have a pending case. I have a dude who has the same issue. he is in pending status, but got a mail for the court.

@ayel yael yes I got married and I’ve written to them to cancel my vawa and that I will be asking for my i485 to be transferred from my vawa to my new i130. they haven’t responded yet but I think they put me in removal because of my previous cancellation of the abuser’s i485.

they sent me a notice to appear but the didn’t put my apartment number on the mail so it was returned to them by the post man for incorrect address. I found out now that it was a NTA because I check my informed delivery and I saw another mail coming that didn’t have my apartment number again so I rushed to the post office this time when I got the mail I was ordered remove because I didn’t turn up and my NTA.

@June 2022 I am not “behind on immigration news”. nowhere before my comment to them1 did it say this person’s VAWA was denied. And they said “they are putting all Vawa applicants in removal proceedings” which is emphatically WRONG! they have explained USCIS sent a letter they never received which is why this happened. Do you make it a point to come out of left field?

well first I just paid 4,000$ for my lawyer to ask to reopen and rescind this absentia order. these people send that mail to me without my apartment number and I feel like they did that on purpose because I saw an ex military service member got deported to Jamaica because he was in removal and he wasn’t aware because they didn’t send the mail to the right address.
