removal of conditions/waviers
hi I got my conditional Greencard 4-6 weeks ago. but me and my wife have been having a lot of issues. we had issues before I got my Greencard as well. but if we did file for divorce how would that impact my ROC. for initial application we submitted, marriage certificate, birth certificate of our child, pictures since we dated, showed taxes, where we lived, joint car ownership and etc. please share your experience!!

Since is a condition u r still tied to her. if u divorce the GC is no longer valide because of the condition. i will advice to hang in there or better still try to resolve the issue. the condition will be on the GC for two yrs. Until that time maintain a valid marriage

you can apply for a waiver inside of the 2 years, you will just need to provide new evidence since the original interview for the conditional card. many people do it, some don’t even have an interview so long as you provide new evidence at the same time in the waiver application

Derrick Boat you are wrong. no law says you should be stucked in an unhappy marriage. He can divorce her if the marriage is not working out and file the removal of condition alone. he will have to prove the marriage was real and in good faith

I agree with Derrick, but also the only way to fight something like that is if she filed for divorce but you’d have to file abondonship & it’s very complicated & there’s a lot if you go that way. I’d suggest speaking with an Immigration lawyer for advice

it’s really not that difficult. look up 751 waivers, so long as he proves legitimate marriage with evidence - bills, photos, lease/house ownership, bank accounts etc…he should have no troubles getting a 10 year card approved

@T G, oh ok! His case might be different in the case that hopefully his wife don’t give him hell but I know a friend went through the same & he had so many difficulties & even deportation court he ended up because his wife told them it’s not real & he had to prove a lot to them. So that’s why I suggested consulting with an Immigration Lawyer for accurate information.

Trident Bx makes a good point. you have a strong case. a child involved. are you being abused? verbally, physically, mentally. gather evidence and file for Vawa. if you can arrange ur issues that’s also good. if you have evidence that u entered the marriage in good faith you should be okay. ild talk to a lawyer.

@mercel libre you can’t file for vawa when you already have a conditional greencard, as long as the marriage was in good faith, get a waiver and remove the conditions that simple

@Tochi, I agree, sorry @S N, I didn’t realized that you said you & her have kids together *that’s the MOST IMPORTANT proof you really need*. I’d honestly still see a Lawyer for advice. My friend case was different, they didn’t have any tithe together.

either way just get a waiver for the i751. however you need the divorce decrees and in all states that I know you must be livimg in a different address and blabla.for a year to file.for.it

@S N go and join the armed force or National guard and spare yourself all these headaches. when you pass the exercises and you are in service, you don’t need her anymore most especially if she is abusive and always making life unbearable for you.

thanks for all the advice. def will get scrutinized during I-751 interview but if I have all the evidence it won’t be a problem. also joining military is another option. curious how long did it take from joining to getting your citizenship.
