@summerlover 07 When I married to her I never thought about the documentation part or green card but unfortunately I had very few evidences of photos and some proof of abuse and that’s why I had a long denial letter. Somehow the new lawyer had drafted story explaining in detail which would had convinced the reviewer about our relationship and abuse with couple of affidavits. I have a question for you! Did you receive any prima facie during this 5 years wait time? If you have then that is a plus, but I noticed some rare cases of long wait approval is due to background check.

@K t I agree that refile will be considered as a new application because a new uscis officer will be assigned to it. Since I have combo card I am planning to fly for 2 weeks vacation from work to my country to chill out the stress because it’s been 7 long years I had never been out of US. I was so frustrated and had a pathetic life in the begining until recently I settled to find a job in my own profession. When I looked back to those hard times I can’t even imagine how I had tolerated and endured. Whatever happened I am thankful to God.

@summerlover 07 Do not worry!! I know some cases were decided after they received 7 PFs. Moght be they have over looked your application or background check which had delayed to such an extend. Should hear the good news soon!

@K t In the previous denied VAWA application, I never received a PF. But I received two RFEs.

@summerlover 07 I have a very important question. Since the time I arrived US in 2017, I had not had any chance to visit my homeland. Now, through refile of VAWA in Sep 2023, I had got a combo card ( EAD + Advance parole) for 5 years validity. Should I take a risk to leave or not? I am only worried that since I am divorced and have no ties, there might be a risk of letting me into the U.S. port if the case outcome is not favorable. Am also thinking though this refile would be considered as a new application, the decision might be quick unlike a fresh application which would process between 2 to 3 years normally.

@h s When I filed in late 2018 for the first time I never PF. I received two times RFE and I never had more joint evidences together and hence that lost my case. I refiled second time in sept 2023 hiring a best lawyer within 2 years of the divorce and received 5 PF till date Luckily I got H1B and my company sponsored me last year. Now I have h1B and waiting for Vawa approval now almost 3 years. PF is a good thing but not necessary. Once you receive denial letter will recommend you the law firm I filed and I bet you should get approved bcoz they are specialized in Vawa filing.

they told me your joint documents are fake but not single off them are fake and they ask me dismissal of order protection and they told we don’t find your phsyological license but he mentioned is license in report and for personal statements they ask me u didn’t mention anything exactly dates when u met

@h s At this point I would recommend you to hire a best lawyer based on the star rating and refile explaining all those gaps with proper justification. This happened to me and now I got 6 prima facie from refile. You will be ok. let me know if you need more suggestion

@h s First decide a good Vawa law firm from excellent rating. Yes, the lawyer will refile a new submission of I-360 and I-485 with all the required documents to support against the denial reasons as per the denial letter. Lawyer will review the denial letter and decide whether appeal or refile is required. Alternatovely, I will suggest you to work on to be ready to file another possible case in the worst of what scenario that this refile or appeal gets denied again.

@h s Appeal is only good if you have enough supporting documents to prove against the denial letter and lawyer will be only to determine. Thats why I suggested to approach a lawyer to know if it has to be appeal or refile. Laeyer will read, understand the reasons of denial and what all supporting documents do you have for him to plan a response letter. My lawyer told me appeal will make my case decide soon assuring it will end up rejection and that’s why he wanted me to refile which will treated as a new case and till date it took 3 years. I was able to get into H1B now as a shield to avoid getting out of status by depending only on this Vawa decision.

@h s If you have a lawyer I would advise you to consult with him. Ask him what is the chance of approval when you appeal? If he say that less chance I will request you to find a new lawyer and then refile with him so that you will have more 4 years wait time to get the decision. Please do not take risk in appealing and if ever you get denied then you will go out of status and have to leave the country.

@h s Did you found a good lawyer? I would recommend you to refile through a lawyer and don’t do by yourself to save money bcoz this is more crucial step and a last chance. So find a better lawyer to refile. if you need I can share my law firm and they are specialized in Vawa

@h s 290b is the appeal. Good job that you hired a new lawyer and file the appeal bcoz the lawyer know what to do exactly based on your case and the denial letter.. It will take anytime between 3 months to 6 months the most.

@Tom Hank’s Hans it was a notice if intent they gave me 33 days. they are asking for more proof of abuse.. when I orginally filed i sent only a psychological evalution, they said they didnt discrete the evaluation but they need more. i wrote a 10 page declaration and now i have 3 witnese statements… that is all i have unfortunately its been 6 years since waiting for a response

@m&m s I would suggest you hire any good lawyer specialized in Vawa and he will be able to help you out in this situation with whatever required documentation. Do not look for the money ! Approval is the goal. For me I have 5 years more time under H1B work visa. Before my H1B visa expire which is 5 years if I could get the Vawa decision which I am expecting any decision. if the decision is positive I am good if not then my company will file the I-485 with what I can indefinitely work , but I had already save much back in my country and after 8 years once I turn 62 will apply for SSN and then leave to my country so I will get Social benefits. I am not interested for green card anymore and don’t want to be in US.

@m&m s Good! but talk with lawyer and find out how much he understood what evidences are required to counter effect and how confident he feels to get this approved so that you may decide with him or find an opinion from another lawyer to see how much confident he is to make this case approve

@Tom Hank’s Hans i got a second opinion from one of the lawyers on lawfully, he said the declaration was detail that could uplift the noid… so idk im hoping for the best. i dont have anymore evidence unfortunately

@m&m s That’s fine and great to know the second opinion verified the requirements as what was stated by your lawyer. May then proceed with your lawyer itself.

@m&m s Yeah! As you know my first Vawa filed in sept 2018 got denied in sept 2023 which is 5 years and then after refile it took another 3 years till date. After I got my h1b I got least bothered in giving my attention to the Vawa. while I was chatting with my friend it was a surprise to see this notification
