Refile or Appeal After i-140 denial
Hi i have two questions and would highly appreciate if someone who has been through the process can help.
1. My i-140 petition is recently denied, and I wanna know if I can ask another firm such as chen to help me with the appeal. I recently did a free profile evaluation through chen immigration and they replied that I have a strong case and would be happy to take my case to file an i-140, though I didn't mention anything about my denial in the free evaluation. Should I mention this denied i-140? I fear that they may back off of the offer they gave me?
2. Is it worth to appeal or its better to just refile the case?

I just let you know that if you have a strong case and the lawyer firm advise to appeal your case, go ahead!!! At the same time my advise is refile your case too! currently the chance to win a appeal is very low but try! You never know!

so in our case we got RFIE. our lawyer suggested to withdraw the case no to be denied. We did so and went with another lawyer. when he saw the case he was surprised that the first one suggested to withdraw. we used the RFIE fixed some stuff and reapplied and got approved. same Texas center. if you have a good lawyer he will know what is good for you

Before appealing, read the denied and approved appeals published by USCIS. You'll understand whether or not it's feasible to appeal.

Refile please, it takes longer to even consider your appeal case. Why wait or go through something not 100% certain you will be approved. Check what they complained about and use that to refile and send in a new and strong petition letter.
I have someone that refiled recently and got approved despite what he got denied for was just a little tweak from the new one he got approved for. All the best @siu izzy
