@M dR I filed January 10th of this year. if I have to wait 9 months I may lose my job. how will I pay my bills?

@shan Luke I think they made a mistake on your case judging by the time frame…usually normal processing time is 35 month..

people usually wait much longer for I-360. did your lawyer file for EAD under c09?

@Mrkvica M. I got an EAD from my marriage filing. I applied for vawa after that and my lawyer didn’t file a new EAD. now this EAD from marriage is expiring, I need one under vawa application. I sent one but no response from USCIS as yet. someone said they wait 9 months before getting a receipt notice

@shan Luke I filled i765,i485 based on pending i360 on Jan 2nd 2024, received i797c receipt notice on Feb 4th. n I filled with waiver my fees was waived.

mine was also approved after a year and then reopened after another year. they said they approved by mistake bc someone pressed the wrong button instead of issuing the PF. so currently still waiting. I’m March 2021

@shan Luke usually you get receipts in a month and EAD in 7 to 9 months. and with the receipt you get automatic extension for 180 days

you will get EAD C31 (under Vawa as you said) only after you Vawa case will be approved.

happened to me… mine was name was updated 2 months after an approval update and when I reached out, I was told it was a glitch in the system and my case is processing normally

@Question Mark I agree with you, the approval in Jan2023 must have been a system error because that’s just 8months after filing which is not a common scenario considering the timeline with vawa. @shan Luke you said you file vawa EAD, is that c31? if so, then you will have to wait till your vawa is approved before getting EAD. I’ll advise you put in another EAD c09 renewal immediately. If you are lucky to get your receipt within 6-8weeks, you can use it with your expired EAD to continue working so you don’t lose your job.

@F A yes, I filed the EAD under c31. can I still put in a renew for the c9 EAD even tho my marriage filing was revoked? I am now divorced and already filed vawa. will they accept a renewal under marriage filing?

@shan Luke Did you submit i485 alongside your i369? if yes, then you can submit an application for i765 and i131

@F A only the 360 was submitted….. nothing else

@shan Luke I see, that means you can’t apply for EAD. Do you have a pending i485? you can only apply for EAD c09 if you have a pending i485.

@F A my 485 from marriage filling has been revoked since I filled vawa. Only the 360 form was filed, nothing else. I had received a EAD from marriage filling but it expires next month. are you saying I will not be able to get an EAD based on vawa filing???

@M dR they approved it January 2023 and then reconsidered 4 days later. it’s been over a year and still no update. it still says my case is being reconsidered. when did you file?

@shan Luke if you only submitted i360, that means you can’t get ead now. if I may ask, were you married to a U.S. citizen? if yes, you can go ahead and submit i485,i765 and i131.

@F A yes I was married to a US citizen. I am frustrated already with the vawa process and simply cannot deal with it. I will be filing a marriage based soon.
