received combo card but 131 still on pending
guys, I’m about to travel but just want to make sure I’m doing right thing. my 131 application is still shows pending but I received a combo card “serves as advance parole” last week. and I overstayed more than a year.. will that be a problem upon my re-entry?

can you try to check with Emma why AP is still showing as pending? I recently got EAD card mailed to me, should arrive on Saturday but AP was produced separately as a paper doc for one year judging from the notice. all updates were coming in a timely manner so it is a bit weird that AP says still pending. I’d not leave before I re-confirm with USCIS that the combo card was intentional and all good to go. do you have a USCIS online account?

@ kurt, sounds like you are good to go. I have never overstayed and I have to admit I am a bit uneasy traveling on AP. i don’t know if it’s worth spending some money to book an online consultation with a lawyer just to be on the safe side, I mean to clarify if overstaying impacts your return coz the AP notice has this scary warning - if you overstayed 6 months you are banned 3 years, if you overstayed 6 months you are banned for 10 years, something like that. I am not sure if approved I-130 and approved AP clear the overstay, I supposed you did check that already.

jules@ I decided to stay😂 I can’t risk everything from here! I talked to my lawyer, yes he said there is a big risk at my side. because of overstaying more than 6 months.. and he gave me one of his clients example which couldn’t make it back! and now that guy is fighting from overseas.. I’ll just wait to be adjusted.. Thank you anyway 🙏🏽🙏🏽

@ kurt, I am sorry to hear you can’t leave yet but I do hope that your I-485 gets approved soon, i-130 takes forever so at least you got that one in the bag! hopefully just a matter of a a few more months. I am curious how long it would take me actually. my I-130 is in Nebraska which is supposed to be 11 months for 80% but judging from experiences shared here it is more like 1-1.5 years. my field office is Houston (22.5 months for I-485) but my AOS application is in NBC and interview waived so May be field office does not need to get involved? I am hoping for better than 22.5 months all in but nothing I can do…what is your field office?
