Question on Consular processing
My L1 Visa expiring in Jan 25 , I have Eb1 C I-140 with PD Feb 2023 . I-485 was not filed concurrently since India dates where backlogged when I-140 filed . Now I have approved I-140 . If travel back to my country can I apply for counselor processing without having L1 Visa when my PD is current ?

Yes. What did you select in your I140, AOS or Consular Processing? If Consular Processing, it will be pretty straightforward but if you selected AOS you will need to file form I-824 which might take 6-12 months to get approved after which you can go for Consular Processing. Even if you chose AOS, you are good because PD Feb 2023 might take at least a year to become current.

@S T - My Antorny says can’t opt for consular processing. he didn’t mention reason , he just replied saying “Unfortunately no “
