Question about I131 and I751
I am in the process of transitioning from a conditional 2-year green card to a permanent 10-year green card and have received a 48-month extension notice letter. I am planning to give birth in my home country. I plan to leave USA on June,2024 and come back on June 2025. Under these circumstances, is it possible for me to apply for an I-131 Re-entry Permit to allow me to remain outside the United States for an extended period exceeding six months?

why give birth in your home country and you know you can only stay 6 month at a time when you are a green card holder

i don’t know why you trynna give birthday in county and planning to stay a year outside of the country when you not even a citizen yet !!! you will lose your reside

@Carina J you can apply for reentry permit. my friend did it in 2019 and first one is valid for 2 years. he was a permanent resident. he was out of the USA for the duration of the reentry permit (2 years). no questions asked when he returned back. as soon as you do your fingerprints you can leave US. just make sure on the form you check to have it mailed to your country US embassy

@Carina J you cannot stay out of the country more than 6months. your green card will be revoked. secondly, it’s best to have the child here and then visit your home country, kids flight free until they are 2 years old. stay 5months at a time. it’s better to do it that way where you don’t have to get the child a visa or petition for the child. it’s way better to have the child here

@Julie Carolan if you haven’t put it on the form I am afraid it is not. you can still leave us after biometrics and have someone mail it to you

@Carina J why not just give birth and leave,you are not citizen and you don’t want your baby to benefit from becoming a citizen I don’t understand why you want to make things difficult for the baby in the future…they have best hôpital,care and USA birth certificate

@carina why are you making case complicated for your self. Don’t risk when you can afford it . USCIS is looking way to deny as many as possible, hence don’t give them the opportunity. I will advise you stay and give birth here or go and don’t stay more 6 months .
