where do you guys get your false info from. “every Premium process application has received RFE” is a bold statement. if you qualify for the NIW, you will be approved. if not, you will be given a RFE to show why you qualify. Part of the long processing time you’re seeing for regular processing is because a large number of people are doing premium and they are the priority.

Most of the cases will be completed within 9 months so you can just wait for 2 more months and see how it goes. It is unlikely that your PD will become current in the next 2 months anyways.

Besides of getting approved/rfe/denied your PD is 06/Dec/2023 and Visa Bulletin Current date is 15/Mar/2023 . In other words you can’t do much even ypu are approved, but is up to you if you want to spend money.

hi @Waiting… Waiting , look, if you have an important decision to take, then do it if you have the money for it. don’t forget we ain’t current yet and unfortunately till that happens we can’t do much, in the matter of the next step. Also, if your case is strong and you know you did it well, there’s no reason for an RFE, don’t trust what you hear!. So if your decision depends on this, go for it.

@T. G. Most the lawyers are saying their clients applying PP are getting RFEs, and they think it is because the agents want to gain time, as they are not able to appreciate all the process in time.

@Duc Hoang I do know my PD is not becoming current in the next 2 months, but I do have a situation with my son turning 21 in the months to come…so if I get a denial, he won’t be able to be part of my new process. 😩Knowing sooner, maybe I can refile in time.

If your son is about to turn 21 it’s in his best interest that you don’t do PP. According to the CSPA rule his age was frozen at 12/06/23 when you filed your petition, but once your case gets approved his clock will start ticking again. Your PD is not current yet, so why on earth do you want to do PP to risk ageing out your child before you are able to file for GC??? I’m on the same boat as you (son turning 21) and I’m very happy about the current delay in getting my petition approved, because my PD is not current yet and I’m buying time for my son. Be patient!

I have a similar position. my son is 21 since last month but I had approved my 140 last year pd 06/06/23 but I think that he need to be under 21 in the interview so I don't know if he will be able to enter in the same process with me. if you know something please let me know

@gabriel ecuador As far as I know, the age only matter until your application. If you applied before his 21st, it stops with your PD. Nothing to do with his age by the time of the interview. Best for you!

My lawyer said that the interview date matter with my son to be part of the process. He is 21 since May. But anyway we will fight to the end. I will let you know when my interview date will come.

@Amir H Thank you for sharing your knowledge! I never heard about the information you gave! I did not hire a cheap lawyer, and We also discussed a lot about my kid situation! Sooooo frustrating! You are totally correct. It’s too risky (and dumb) to apply PP right now, when PD isn’t even moving forward… By the way, do you have any information about the PD moving forward this year than 2023? Last year, Visa bulletin PD was frozen 3 or 4 months!😩 My point in getting a quick response was to be able to refile if I get a denial and include my kid. But it would not help anymore at this position. Hello My PD is 6 June 2023 with premium processing and they approve it 9 June 2023 ( yes 3 days) and my kid just turned 21 on 17 may 2024.

@gabriel ecuador You should not have done PP. When you file your I-140 your child’s age gets frozen until your petition is approved, which means you will buy more time. I filed my I-140 in Nov 2023 when my son was 19 years and 10 months. I’m still waiting for my I-140 to be approved but from the USCIS perspective my son’s age is still 19 years and 10 months. I’m sorry but he may no longer be eligible for a GC as a dependent.

@Amir H it's the same case for me. If your son gets 21 before your interview date he will not be eligible for the GC. it's that correct?

@gabriel ecuador You said you son turned 21 already in May. If that’s the case he has aged out already. My son’s real age is now 20 years and 5 months, but his CSPA age is still 19 years and 10 months. USCIS cares about CSPA age only. Your son’s CSPA age is only 3 days less than his real age unfortunately, which doesn’t help. Sorry but that’s what I think.
