PLEASE READ- Campaign to call Biden Administration to get EAD AND AP WHEN FILING I-140 only
Hi guys, My PD is July 2022 and I fall in “other workers” category. I was doing some research and found this campaign to sign a petition for the congressman of your area to bring up the issue of the visa retrogression which for my category is currently PD December 2020. This petition is to be able to get the EAD and advanced parole (travel permit) once the I-140 is approved instead of having to wait until the opportunity to file I-145 which with this retrogression will take forever. This is good idea but there is something called as OPT, STEM-OPT & H1-B which issue EAD. People from India and China waits more than us. EB2 , EB1 applicants too wait but USCIS do not care , and we are in the hope of change of system for Unskilled Labors. If EAD and AP is issued based on approved i-140 there is no need of H1-B visa category.

@S Ram I get your point but this would be a petition until the times go back to normal. This retrogression has never been seen before and it’s ridiculous!!

@Pauli Lo the retrogression has been way worst than this.look at past visa bulletin. This proposal was made to help indian national there way time is 134 year before they are able to get their GC. yet still they didn't implement this suggestion to help them. The was basically the suggestion that was made when even Congressman ask to make all the dates current, so persons can file their I-485. Do you know how much I-140 is approved every year do you think they want to issue this much defacto GCs. I am not saying it not a good proposal but it's chance of passing it very very very low but not impossible. passing this executive action would basically destroy all Non-immigrant visa category. The major groups against these proposal is actually some employers and lawyers because with EAD you easily change your job able to get a pay increase start your own business. no need to spend money on lawyer fee to extend your Non-immigrant status. USCIS also loses these fees. Plus the well know talking point of immigrants are taking our jobs, you we hear this even louder. hence why opt, stem opt and All work visa gets that much push back. If there is no legislative or executive change retrogression will be here for a very very long time. The numbers show this plus every person now with TPS and asylum eventually will apply for a employerment base GCs. And they don't have the problem of waiting to work because the already have a work permit and AP from TPS. so they don't have to wait on filing I-485 to get these documents. employer love this because the can start working right away and employers know they not going to leave because the want that GC.Guys look forward to very long wait if no changes. sorry to say but if those extra COVID GC miss you that very unfortunate . Also remember it's a election year no politicians wants to touch immigration.

yes i get your point, nice insights. I was not talking about Indians or Chineses. I was talking about eb3 category and this proposal. This retrogression happened before. Hope it can get fixed soon @hello mark

@Pauli Lo we know your talking about EB3 row we just saying that these are the reason against this proposal. remember major support of thus proposal are actually Indians and chinese from the backlog countries not Row. hope the retrogression is not long but 1+1 is not 3. The numbers doesn't support our desire unfortunately we just have to see how bad this retrogression will be.

@USCIS IS A MESS the solution for that is have persons work on their receipt notice. This solution is a temporary fix a good one but if this pass it will only increase the backlog exponential. Guys we got to hope for the best and not forget to enjoy of life.
