US Citizen - Petition for Father (i-130) california service center
my lawyer filed I-130 USCIS received January 4,2023 and i got receipt notice. but i noticed that category is incorrect, showing petition for child instead of parent. they submitted a online inquire to changed category May 3,2023. august 30, 2023 actively reviewed by uscis. October 26, 2023 my paralegal message me and said USCIS said they cant see that i have a representative. my lawyer sent a new g-28 form on January 11, 2024. I called USCIS September 26, 2024 to check if they fix the category already but they cant give me any information that it got changed, and they told me that they can only see that i have a representative now. im still waiting for the decision. how long do i need to wait to get my case approve? its showing that my case is taking longer.

@hello_ kitty without knowing ur service center, it's hard to predict exactly how long your I-130 petition will take. Delays from the category error have likely extended ur processing time. Typically, I-130 cases take around 9–12 months, but checking the processing times for ur service center on the USCIS website can give u a clearer estimate. Stay in contact with USCIS and ur lawyer for updates.

Try local congress inquiry, also you may think to file mandamus. They will respond within 30-60 days with a decision. As this person filed

hi jaycee thank you for your comment. when i called USCIS they told me that the case decision is going to be nov 16. can they see when they going to decide for you case? because in my account its not showing anything about expect case decision.
