Pending I-751/ Separated
I have a pending ROC for over a year now and my spouse and I recently separated and on the verge of divorce.
Currently, I’m stuck between just waiting for a response on my case who knows when thatll happen 😑 or getting a divorce and updating my file to a I-751 waiver.
has anyone been in a similar situation and how would advise?

well, the question is, do you want to risk your ROC if they schedule you for an interview and by then your spouse doesn’t come with you they will deny your case. if marriage does not have safe, start divorce procedures and if you need to provide new evidence in the future and have the divorce degree send that to them. it’s better be safe than sorry.

i know. I’m just hoping there’s no second interview. bcos most pple just get just get approved without interview. but i definitely agree. better safe than sorry

@dream chaser I am in the same boat! There’s unfortunately no other solution to this but this means that we will be called for an interview for sure once the waiver has been filed.

@A B I’ve read about some waiver cases that got approved without interview. it can go either way. just gotta stay hopeful
