Parents getting rejected at visa embassy, despite son’s American Citizenship!!!
My spouse is a citizen, and is trying to get his parents into the U.S to begin the petition process on their behalf since the other option could take a very long time. They have been rejected twice for no reason, he also provided invitation letters. What could be wrong? I would want to believe a citizen has certain rights to bring in a parent or even both. Please advise.

You are applying for B1/B2 tourist visa(non-immigrant) to come to USA and adjust to immigrant visa is a conflict of interest! The denial could be solely based on that the counselor doesn’t believe the applicant have intention of returning back to their home country!

You can't use a B1/B2 non-immigrant visa with the purpose of adjusting status once they are in the US (it's considered fraud). If the consular officer noticed the migration intent, pretty sure that's the reason why they were rejected. The US citizen has the right to petition for immediate relatives, but at this point your spouse needs to start the petition via consular processing not with AOS.

I had the same situation when I applied B1/B2 for my mom about a year ago. I’m now applying Immigrant visa IR5 (greencard) for her and been waiting for NOA2 hopefully soon. Try applying IR5.
