@a k I would advice you write to them to withdraw it but I recommend you reach out to your lawyer if you have one or get legal advice.

@a k This sometimes happens when USCIS reopens a case on its own motion. Even if you did not file a motion to reopen, USCIS can reopen a previously denied I-485 if they believe the denial may have been incorrect or if there is a related petition pending (for example your I-360 VAWA approval). I think an important thing to consider: do not withdraw it immediately. If USCIS reopened it themselves, it usually means they want to re-review the case. This is not a legal advice!

@a k at the time of your Marriage based denial , when you Failed to re open the motion or refile were you issued or rather served with any other notice? and then how long did you take before filling VAWA? am asking this because I recently received a denial of 1 130, currently having a pending assylum, am planning to file VAWA
