my husband is filing the i864 form for me (overseas) for this year 2023 he only got the 2021, 2020 and 2019 previous tax returns, didn't fil the 2022 tax return yet ( gonna do it in october) will we have a rfe for that.
ps: He meets the required income for all past 3 years.

Possibly, because they require the return or transcript for the most recent tax year. Is he in one of the States which are allowed to file later this year? If so, he could submit evidence of that with the i-864.
