notice to appear
what happened if someone filled for marriage based green card without knowing if they had a notice to appear. Will uscis deny the whole application or proceed with the application and let you know that you had a notice to appear on the interview? anybody had that experience

they can process the application but he have to see the Judge before USCIS send the GC

ok but I've heard that someone who has a notice to appear cannot apply for green card they must apply for i130 first then after it approved they can proceed with the rest of the applications in front of an immigration judge. I've heard that some people never received the notice to appear and they apply for everything at once and then they find out they had a nta at their interview which they never knew about

ok after 1 month of my marriage with my US Citizen wife , the ICE stop me on the highway without driver license and put me in jails and when I see the judge he tell me my wife have to send i130 to uscis after they approved before my court date and the Judge close the case and give me my GC

oooh so u was already married before u got caught well your case is different from when someone get notice to appear and then get married after that

nope they look at different when u get married after u receive the nta they will make it look more suspicious thinking that u get married just avoid deportation yes the process will be the same but yours doesn't seem suspicious because you was married before u got arrested

yes you know people get married in jails to avoid deportation and the IG granted a GC

yes but they have to show that they was in a relationship with that person before they go to jail and also people get deported if they can't prove that too. it's as easy as it may sound. you can be married to us citizen and still get deported if u can't show that your marriage is boni fide

your main issue is going to be you proving your marriage is bonifide with USCIS when you apply for the I-130 . it’s going to be hard but you need more prove to win your case

@momar Diokhane. I have the same case as yours. I got married to my US citizen husband on September 5th 2019 and got arrested by ICE on December 3rd 2019. I was detained and released ans since then I have been checking with ICE. my i130 has been pending since April 2020. can you please send me your email to get intouch with you

you’re gonna need a real good lawyer to get this case approved. if they find out or you give them fraudulent information, the application will be automatically rejected and your spouse kicked out

@Momar D; pls I need you shed more light on your case. Did you file I-485 at all? If you did — did you file I-485 directly with the court before the court gave you your GC? And how long did it take for USCIS to send you your GC from the day the court gave you your GC?
