No status change but have news from congressman
I have applied for Vawa and i485 in July, 2019. Vawa was finally approved this year in April. i485 case moved to NBC (the last I have been notified), request for evidence (medical) sent and recieved. No news since then and that has been 5 months, soon to be 6 months now. Online status still shows nothing but that they have received my medical. I reached out to congressman due to inactivity (processing timeframe has been broken long ago) and due to lack of information when I called NBC an agent told me that they dont have my case (which they do I have official uscis letter that jurisdictionhas been moved to nbc). This morning I received email from congressman saying that they have information about my case and I have been denied on October 3 because I didnt show up for interview on September 28. I have NEVER received interview invitation and even uscis status online doesnt show that interview has been scheduled therfore I could not have possibly known. Anyone had this experience???

I’m sorry for your sad news but that’s why it’s always good to use a lawyer but I think there’s a waiver you can get and they will reschedule you but seek an immigration lawyer advise

@M Ari i've been waiting since nov 2018 and no news at all. this is what i'm scared of - that my case is lost. my lawyer tells me to wait but not sure will it ever be my turn. how is this possible that they called you for a interview and you never received that letter?

@M Ari I got almost the same response. my status says interview rescheduled since 2021. I contacted congress 4months after vawa approval and uscis replied congress saying interview has being completed awaiting for adjudication. meanwhile I never attended any interview. and my status remained same, no change and it's being almost 2months.

@M Ari can you make an appointment to come in their office to talk im very scared too because they didn't update anything have they ever sent you the interview letter? or maybe lost? can you try to submit the E-request of the missing notice?

I am sorry to hear that. you or your attorney should receive the denial letter soon. I think you have the right to file the appeal and reopen your case - I hope you have an attorney to help you on that. I see some posts here that some people appealed after denial and they got it at the end. it is draining but you are going to get it, almost there!! I encourage everyone to take screenshots of the status so in case of something like that, we can show the proof ….

I think you must file I290B appeal or motion to reopen and reconsider immediately, within 30 days of the date of decision if served in person or within 33 days if served by mail. on the denial letter, they explained why it’s been denied and what to do the next (appeal and motion). it is strange that you don’t even receive that mail yet… please have your attorney to work on that asap to find the right information and work on that I really hope you will resolve this issue asap.

@M Ari i have seen a person got a notice saying from Congressman that he getting the interview but turned out he didn't get interviewed, and they approved right the way i think you should send the E-request through USCIS website so they can address any issues if it's on file otherwise i think it's a glitch or maybe a wrong case they got usually it will be updated even it denied not staying the same status

@Question Mark and I do have attorney from very begging of my case. @Mrkvica M. I do not know. Honestly if it wasnt for congressman's office I still would not know because even system status online is not showing anything but that medical was recieved on June 7. So no letter for the interview that was apparently scheduled for September 28 and no letter for decision on October 3 (denail due to no show). @Yuujirou Hanma I dont know what is FO. No I did not move, regardless my attorney is the one that receives all my mail, so even if I moved it wouldnt matter my mail goes to my attorney's office. @D N no, no mail, no letters whatsoever. no online system update. Literally nothing even now! I am working with congressman trying to find out more, like where my case is to begin with since last time it was in Vermont but it got transferred to NBC in April and ironically I called NBC on about a month ago and they told me they dont have my case (they do since they requested me to send medical and I sent my medical to them and they updated and notifed me that they have received my medical at NBC). @skylar . I actually took screen video recording with todays date on google search and than I went to uscis website and recorded (all same video) the current status that hasnt changed since June 7 and that is rfie was recieved I will actually at this point sue uscis for bringing me to this situation and denig me and still not even notifing me about denial that happened month ago at this point nor online system had changed so if it wasnt for congressman's Graham's office I still would not have any recorces to know what is currently happening.

@M Ari can you go on website and request E- request it should take a day to get response and you will receive what they saying on email otherwise i think you should make an appointment to go in local office and talk

@M Ari FO means Field Office, state where you live…the reason I’ve asked is because after you sent medical to NBC, they decide there to give you the green card or to forward your file to field office for an interview…I believe you should contact/infopass your local USCIS office they will be able to give you more info. @Yuujirou Hanma no, usually depends if nbc wants interview or waived but yea i see the often people getting wavied from nbc but i think it could be a glitch since it not even updated if it is denied i think the better chance is to make appointment and come in local office to ask the question about it

@Yuujirou Hanma @D N I am in Florida and NBC is in Missouri if they wanted to interview me should they have notified me that the transferred my case to Florida? I literally have no updates even now, online my last update is that on June 7 they have received my RFIE and that they are working on my case again. So if it wasnt for congressman I would be clueless about interview and denial.

@M Ari In most of the cases USCIS don’t bother to update that the case was transferred (they didn’t showed that my case was transferred as well)…Like @D N said possibly could be a glitch in their system too. Your best bet would be to make an infopass ASAP to your local Florida USCIS take your receipts and speak with an officer…they will instruct you what to do next. Hope this helps!

@Yuujirou Hanma Thank you. I will do that, but I am also changing attorney. I agree that sometimes they dont update online, but not to update scheduled interview or even worst not to update that decision has been made, denial, is a little too much. I guess its a glitch that costed me a lot. Now I have to clean up this unnecessary mess.

I have a similar situation in regards to medical rfe. I got the rfe letter in late june, replied on July 21. no receipt and no news for over 100 days. To add more, my latest status on the portal says that “status changed to show fingerprints were taken” back in February. So it never even changed to show that they sent or received RFE. my case is at NBC as well. Super frustrating experience. Hope it will get solved for OP and everyone on this thread affected by the delays 💜

@I A I know the person that works with congressman so immediately..not very reliable to give you an avrage timing. I also reached out to white house but they were straight up usless. most help was actually senator and cogressman but really I just had connection.

@Viola Via then for sure reach out to someone. congressman or senator because that is not very normal. and when you call and speak to USCIS they are usless on vawa cases to give any information.
