If your 360 is approved you can file 765 based on your approved case(C31). Not C9!

@Mr uscis blog yes. My 360 was approved. But I-485 denied because they lost my medical. We made an appeal. So my C31 almost expired. Last month my lawyer filed for renew 765 form for C31. Because you can not extend you C9—> 485 is denied. It is like a chain

@Bakhtiyor M his I-485 denied! How could he file C09? No, under C31 based on approved 360. I guess your 485 is not denied that is why you did C09

@Bakhtiyor M I just did renewal of C31 and also got a receipt. And yes, my 485 was denied as well

@Mr uscis blog if you appeal they’ll deny and give the same answer that, you never responded to their RFE they don’t care if you got it or not this issue cost me a lot of problems in 2017. I had an in experienced immigration attorney he went ahead to file a motion to reconsider big mistake and they denied and closed the case because you have only one shot of appeal on that case. Get a very experienced immigration Attorney, they should petition USCIS for your file like FOIA the RFE you didn’t get is in there, they keep copies then your attorney would gather the requested evidence and file a motion to open with new evidence and this will work! Trust me. I’ve been dealing with USCIS for yrs now, they don’t have time to waste.
