@GC- so happy for you!! hope you get it soon!!! can you provide some insight on documents you submitted for expedite, and how did you expedite?

There has to be a reason. In my case it was loss of job and also loss of revenue to my company if I don’t work for them. I put the expedite request over phone call. My VISA expires next month which cannot be renewed so I mentioned that. They obviously have my VISA information to confirm my statement. You can get a letter from your HR if you leaving work will cause a loss of revenue to the company.

i see. thanks for your input. do you think it would be a good idea to expedite via congressmen? i am the beneficiary of the primary. i used to work on H4EAD. but had to quit because i still havent got my EAD. do you think even that public charge rule is no more applicable during the expedite request the adjudicating officer will not take that into consideration?

From what I have read it is variable and depends on the officer re the conflict of that public charge rule. Also, I see a lot of people apply through congressmen. Not sure of that increases your chances of getting an approval. In my case I am appalled that even after 2 weeks of approving my expedite request, I still don’t have my ead at hand. case status still says “expedite request approved”.

@GC- thanks for your insight. is your service center NBC? i thought post expedite request approval they should approve within a week. i think at the end of the day it depends on the officer adjudicating our cases.

@ rrhy I am in the same situation as yours. I have 2 EADs (H4 EAD and I 485 EAD) pending since October. for the I 485 I have my bio on April 28 and for h4 I had bio back in nov but no news on either EADs. my employer gave a letter to Expedite but it got denied. I am also not able to work since feb. this is so frustrating. I am also hearing that people getting EADs approved within a week of biometrics but I don’t know what’s going on with USCIS.

@rrhy - yes I think so too... and yes it’s at NBC.

@mims- I understand your frustration as i am going through the same. i lost job on November. been 6 months. tried to expedite h4ead didnt help. didnt even had my biometrics done for h4. did you expedite your i485 ead?

@ rrhy no I just tried expedite my h4 ead because you can only expedite after your biometrics. and for I 485 my bio is still pending.

oh so even after biometrics h4EAD was not expedited? did you try to expedite via your local congressmen?

@ rrhy no they denied it. they said your case doesn’t look like its urgent. I just tried using a letter given by my employer. I am planning to do it through congressmen next.

@mims- so here is what i went through. they applied my fingerprint towards my H4ead and not towards my h4. i tried expediting through congressmen, senator nothing happened. i submitted financial loss documents (employer letter stating that it would be a financial loss to the company), i submitted medical bills that i had to pay, rent due letter. i tried all the tips, advice that i could find but guess what nothing happened. Till date i didnt even receive my biometrics appointment. been 8 months from receipt date. NOTHING.. at this point i am scared to the core to even exepedite my GC EAD. hence i posted this in the forum to seek help, advice and guidance if GC EAD expedite at all works for the beneficiary.

@ rrhy this is so not done. I have a friend who was told by the tier 2 officer that it’s difficult to justify your financial loss specially when you are a dependent and mostly the expedite request is approved on the basis of financial loss when it’s for the primary applicant. I will have my biometrics on April 28 for GC EAD live agent told me the same through chat. I haven’t received the letter yet.

@ rrhy which centre is processing your h4 and h4 ead? mine is texas

@mims- i agree with you. the whole point of having the H4EAD is to allow the dependent of the primary to work. i don’t understand why they have this notion that financail loss is not an option for expediting cases for H1B dependents. also did you notice their processing times keep extending. you cant even submit a request outside normal processing time. all this time i thought GC ead cannot be expedited because of the public charge rule. now that it is dead, not sure if the exepedite would at all work for EAD, as i am the beneficiary. i am scared to expedite anything right now, with the experiences that i had with USCIS. even ombudsman didnt help. i did everything but looks like they dont care at this point. what to do? we are at their mercy. the soon we start accepting that we wouldnt be frustrated. its hard to practice in real life. i am so demoralized now because of not able to work for 6 months.

@ rrhy Being on the same boat I can understand your situation completely. it’s so unfair not to categorize the loss of job as a financial loss for dependent. Yes they are extending the timelines every month and I remember Texas was one of the fastest centers previously and now it’s once of the slowest I believe. I have seen Vermont and Nebraska EADs processed faster. I am just hanging in there and hoping to get it soon. my filing date for h4 and ead is oct 9 and I 485 with ead and travel is 30 oct.

@mims- same here. i left everything on God now. hope we get ours soon. if i hear anything back i will post it here. if you get any update please let us know here. looks like all our EAD’s are sailing on the slowest ships Texas and NBC. 😩

H1B's are supposed to be financially able to take care of themselves and their dependents, that's what the visa is. So technically it is not unfair (I think from govt perspective) But I agree with you and hope processing happens quicker, so you can be back working. have faith, you will get there soon!

@GC- probably from Govt perspective makes sense. but like say for example dont know if a beneficiary will be able to expedite EAD or not? what do you think from USCIS perspective?

@ rrhy_girl NY... I got my h4 approved last week and unfortunately h4 ead is still pending. looks like all h4 and h4 EADs are generally approved together of applied together but didn’t happen in my case though. any updates on your cases?

for the h4 too i expedited, got denied.. 😟. for 485 ap i expedited, not the primary applicant.

oh ok. and the 485 ead expedite request was approved? my attorney told me that they are not approving ER for secondary income applicants and that’s the reason I got discouraged and didn’t do and my first expedite request for h4 ead was denied back in January and I didn’t do it for the second time. I hope to get atleast one ead soon. I am so disappointed with all this delay

i expedited my Ap only as there was a death in my family, and i needed to travel. for EAD i heard the same as well, they dont approve for secondary income.

Hi Everyone I have expedited my GC EAD on Jun 30th and got approved on July 6th, since then I didn't hear any response from NBC, usually processing time for expedite request is 1 week, don't know what is happening in my case, it's been 17 days. If anybody is on the same boat, let me know.

I tried multiple times showing the reason for job loss, financial loss and also company losses. but the officer did not approve my expedite request? I tried with local congressman office as well. what else can I do in order to expedite the ead? any other suggestions?

if you have a lawyer, ask them to contact uscis. In my case, they approved my expedite request and fhen never actually approved my ead until my lawyer contacted them. at that time they again opened a new expedited request which was approved and my ead was sent to me. I also tried congressmen and since I live in California they take forever to respond.
