Need Advice on Pending I-130 and Re-entry Options
Hello, everyone, I’m seeking advice on my immigration situation and would appreciate any guidance. Here’s my story: I married a U.S. citizen and received work authorization, and everything was going well until October 2019 when my father became gravely ill. I traveled to my home country to visit him, but upon returning to the U.S., I was detained and questioned by authorities. They found personal messages between my wife and me, which they used against me. I was given two options: leave voluntarily or stay in detention. Fearing for my father’s health and being told I wouldn't be able to contact anyone for a long time, I chose to leave voluntarily. After leaving, I hired a lawyer and filed an I-130 petition in 2019. However, I haven’t received any updates from USCIS since then. When I check my case online, it still shows as pending. My wife and I have been waiting for years, but we’ve lost hope. I have a few questions and would appreciate any advice: Is it worth continuing to fight my case if I return to the U.S. by crossing the border? If I get caught crossing the border, will they send me back immediately, or will I be detained and allowed to remain in the U.S.? If I make it to the U.S. before the current administration leaves office, what are my chances of avoiding deportation if I live in a sanctuary city like Chicago? If I manage to enter the U.S., would I be able to reopen my case and continue the process? I’ve heard stories of people crossing the border and staying without any issues, but I’m worried about how this might affect my case and future. Any advice or similar experiences would mean a lot to me and my family. Thank you in advance!

yes u will be deported if caught and your case will be more complicated. were you given a travel banned after u leaving voluntarily. you should have applied for your I-130 after that travel banned has elapsed. speak to a lawyer. please don't complicated ur case by been caught

benjamen mante i have now given any kinda banned on my passport. they just wrote revoked on my visa with marker and that is it.

i hired a lawyer and did spend lot of money and also reach out to congressman at that time but nothing happened now.

yes you have a travel banned from the 🇺🇸 contact a lawyer. there are good ones. now you cant fight with you own strength. find a good immigration lawyer and tell him or her everything. you have a good case cus u have family.

@jackli madona What visa were you on in the US when you got married? How did you obtain a work permit? I was denied entry to the US about 1.5 years ago because I had no ties to my country (Canada), I had been living in Costa Rica when I met my now husband. I returned to Canada and stayed at my parents. I was not yet married. I told them at the border I was going to visit my fiancé. They denied me, finger printed me. I then bought a condo so I could show ties to my country. I was then allowed to travel back and forth. We got marrried just over 1 year ago and we did a change of status. I would not come illegally. Where are you from? Where would you cross if you came? If you come illegally you could do a change of status but you would need to get 601 inadmissible waiver for unlawful entry. These can take a long time and you would need to show that your spouse is in hardship without you. I am sorry for what you are going through as I can relate a bit with my denial.
