need advice
guys I have question i received this email from my lawyer in Last December 2025 PD is Feb 2022 We have recently received word from company that they have decided to no longer proceed through the PERM program. This was not foreseen as we had good conversations leading up to this point, but we cannot force the employer to continue if it is no longer in their business plans. At this stage you have received the benefit of an approved I-140 with a priority date that you will maintain. This means your priority date from the company filing will still hold for your new application. Therefore, it is likely you will have little to no wait time for the visa interview following the approval of a new I-140. We have employers who are filing PERMs in the next couple of months and we would like to have you included in these filings to continue you on your green card journey, without delay. We will do everything in our power to keep you in the same spot with no additional fees. I told him to go with the different company and they apply already in March 2025 and my new file is waiting for PERMs approval any idea what going to happen I’m from Canada please advise thanks

You must wait until your new PERM approved. Then they will proceed to file a new i-140 with porting your very first PD, which is Feb-2022. At that time, if you are eligible to file i-485 in according to visa-bulletin, you would also submit i-485 concurrently with i-140. Otherwise, you must wait for your PD Feb-2022 to become current by DOF or FAD.

You are still in a good position. Since you already have an approved I-140 with a Feb 2022 priority date, you generally keep that priority date for future filings as long as there was no fraud or material error. Even if the first employer stopped the process, your priority date can usually be reused with the new employer’s I-140. - Attorney Ana Gabriela Urizar (All information shared here is for general educational purposes only.
