N400 under 3 years rule
I received my 10 years green card in June of 2021 and will be eligible for N400 under 3 years rule by 2024. Filed for a divorce last year but did not move forward with the divorce. will previous divorce filing affect my eligibility under 3 years rule since we are still married?

You should consult an attorney. If you guys are still married and everything’s cool I see no reason why you can’t file based on the three yr rule. In my case we was just separated and not divorced but I didn’t want to risk it so I waited for 5yrs instead and I’m going through the process right now.

Stanley, when did you apply? How long have you been waiting? Do you have 10 years?

3 years rule is for person who got conditional GC by getting married to a US citizen. If you are still married to US citizen while having your 10 GC, then you can apply for N400. However, you must be married when they call your for citizenship interview and the oath ceremony.
