Good afternoon friends, still my husband is waiting to get a decision from USCIS, he had his interview in Newark NJ office 4/29/21, 3 months later 8/6/21 had RFE, my husband responded to RFE on 8/30/21, still no decision, our attorney did inquiries because the case is out of processing time, contacted Congressman and no answer. What else we have to do before do a Lawsuit?

@kiki luis RFE was certified disposition papers about one case it was sealed and the outcome of that case was dismissed.

@C J we are considering do the mandamus even if we know there is not a guarantee of approval and we already know we are going to spend thousands.

@ Lisa normally when you first threaten them of a mandamus they will make a decision Bc they are trying to avoid the lawsuit itself

@ Lisa it’s basically asking your lawyer to write a letter to them saying that if they don’t make a decision on your case within a certain period of time you are going to sue them them in court and ask the judge to force them to make a decision on your case or the judge will take over the case and make a decision for them

@ CJ we didn't know about this, actually we asked our attorney about the lawsuit and he is not agree to do it because according to him, we are going to piss them off (USCIS) and they are going to deny the case automatically. We are looking for another attorney to do the lawsuit if its necessary. Our current attorney sent a letter to request for service but that's it.

@ Lisa yeah a lot people think that way that if you sue them it will force them to deny the case but they that’s not always true. Besides that’s why I said you can threaten that you will sue with a threat of mandamus and not actually file one that will force them to make a decision and if your lawyer don’t want to file a mandamus he can just threaten to file one

@ Lisa the first step is first threaten to file one and if they don’t make a decision within the said time then to can file one . Also remember that they have 180 to make a decision after the interview Bc you can do any of that
