n400 i751
I have a quick question, I’m divorced, can USCIS go back and call my ex wife to ask questions after interview? is this a common practice by USCIS?
I did my waiver interview and officer was very cold, and I don’t think it went well. we finally now got over the divorce, with all the problems and paper work and it’s finally finalized. our relationship is terrible now and I’m worried that USCIS reach out to her. let me know your thoughts

no they won’t! because they aware that she can lie just to put you in trouble! since you’re divorced it’s fine

@Mr wonderful thank you, I really hope so. I see ppl here saying waiver cases are chill. I had the opposite experience, from saying hi to the officer, she is looking at me sketch. I basically had to try hard to convince her other wise

well, you didn’t explain enough what was ur interview about ? i-751 or combo interview with N-400 ? if so ! when did u divore ? before filling i-751 or after u swich it to waiver ?
what was ur service center & when did you file for i-751 ??

@Beko Ali ya my bad all these terms are confusing to me. i751 already approved previously. it was for the n400 interview. filed after 3 years, interview was after 4 and divorce happened at 3.5

@sf filer well, if your i-751 approved then u r permanent resident now. but, if u r divorced before n-400 interview you are not eligible for citizenship 3 years catugary, u need to wait till 5 yrs to be eligible .

@tom G thanks Tom for your replies. so even if they approved i751 waiver few months early. now they able to do this after the n400 interview? this is just crazy. sounds like a never ending mess

if u applied N-400 or marriage base like 3yrs rule n if u divorce on the day of oth u ll denied ur case and u have to refile when ur 5yrs complete..
cz this was happened to me I applied on 3yrs n we filed divorce and after interview they denied my case the I applied again after completing 5yrs now after 8 months of interview they asked for final divorce decree but my divorce in still pending i send them last court order n affidavit from my attorney
so here is the complete answer of ur question but still i wish u good luck and u ll get ur citizenship with any problems or wait

@Muhammad khan thank you, did they deny you right away at the interview or later? the law says it’s under officer descretion to approve or deny of divorce happens. but anyways what bothered me all the questioning again. she was asking me about dates and things happened in a relationship 5 years ago. even tho my green card just got approved few months back. it just felt like a never ending hustle that will never stop

law says if u r bonafied married for three years and u have to b married and stay together till ur oath ceremony then u r eligible for 3yrs rule
and if u stay together for 3.5yrs and u filed citizenship and between ur case u r separate or divorce then u r not eligible for citizenship and u have to wait and complete ur 5yrs or LPR and then u can apply for citizenship
so when i filed on 3yr rule and my case ur pending and I filed divorce so they denied my case and said its not a bonafied marriage
again i wish u best of luck and u get ur citizenship cz its very frustrating for us

@Muhammad khan I file I-751 waiver Bcz I my marriage can not complete 2 year but I came to US in 2017 & I file I-751 waiver in June 2019 what do you think I’m eligible for N-400 or not plz let me know

@faizan naeem like in ir situation u have to provide proofs as much as u can that ur spouse was abusive and then u decided to get divorce if u they approv ur i-751 then u r eligible fr citizenship after getting ur I-751 approval but if they denied ur i-751 then it ll problem fr u I suggest u , u can consult with attorney get ur citizenship through VAWA

if you're divorced you have to wait 5 years having gc to get citizenship...you can apply 3 years if still married
