My GC is approved but Daughter's still pending
Good news is that my GC is approved. When I filed, daughter was under 14 so even though we went to ASC for fingerprinting, they declined to take. I was on L1A (so she was dependent L2). My GC got approved on 17-Mar and I received notice to complete her biometrics scheduled on 3-April. But attorney is saying that she has gone out of L2/ NIV status. They are yet to get back to me on what needs to be done but wanted to see if anyone else faced similar problem.

Got confirmation from Attorney. Her pending I-485/ AOS application protects her legal status and I-94 is no more applicable. Huge relief :).

Here is the timeline -
PD: 10-Apr-2020
RD: 23-Jul-2024
Biometrics: 25-Sep-2024
EAD Approval: 07-Oct-2024
I485J Approval: 23-Jan-2025
GC Approval: 17-Mar-2025
Location: NBC -> San Fernando Valley FO-> NBC.
It was bit of a back-n-forth between Oct 2024 & Jan 2025 as doctor was not aware that guideline was revised to include polio vaccine as well. So we received another RFE, which was responded and then USCIS misplaced my medical form. So another RFE was reissued. So in all there were 3 medical related RFEs.

@saurabh gupta congratulations! I am in the exact same situation wrt 485 being pending for dependent child while it’s approved for parents .
q1. what’s the country of chargability for your daughter ?
q2. do you know why they suggested to not do her biometrics earlier but now they are suggesting to do it?
my child’s case is in Santa Ana field office.
during her biometrics they only took her picture , no fingerprints but that may be due to her small age.
q3. have your received the green card for yourself and your spouse ?

@saurabh gupta any update ? I’m stuck on the same status . did you ask congressman or take any other action? I am told if primary’s GC is approved, all dependent visas eg L2 and H4 get cancelled . which means dependent is out of status . this means dependent can’t leave US until they receive a GC approval. I’m concerned this is a tricky situation- are you aware of this and taking any action . please share what you want.

@battling giants - this is correct. They go into AOS pending status. My daughter has turned 14 this year so she has biometrics appointment on 4/3. hopefully, it would get approved. Pls be patient. I haven't taken any action as it was not yet past normal processing timeliness. filing AP would be an option though.

@saurabh gupta yes AP is an option but I wanted the freedom to travel internationally so didn’t apply . in my child’s case , biometrics happened on 10/7/24 along with the rest of ours . our case was approved but not our child’s . I would have waited but have an international travel for medical reasons in June .
my lawyer didn’t inform me about this scenario else I may have applied AP for my daughter . anyway , I’m planning to apply AP now in the hopes it gets approved before our travel .

@battling giants - Pls reach out to attorney. there is a way to file the form online (https://my.uscis.gov/account/onboarding/filing/new) but I am not sure if category c09 can file it online.
