wait until you get termination letter and then your lawyer has to resend everything together including the receipt you got when you first apply I-485, your lawyer has to include cover letter to explain everything including the payment for your I-485

is uscis gonna start my i485 over again or my i485 that i sent before still gonna be in the queue?

I think once you get the notice from the judge call Uscis and ask for a info pass and they will send you to the closest field office. congratulations 🎉🎈

@Rene Emma am also waiting for I-130 interview before filing motion to terminate in court. For now chances are 1-2 interviews for our situations. That's if the judge doesn't want a hearing.

I didn’t go through interview for i130 my i485 still pending so I don’t know how it’s gonna go

you filed both together.... my lawyer advised us to file only 130 since my case was still in court and once the 130 is approved I can request for the judge to terminate my case and file 1485... that was why I asked if they would be interview again for the 1485 form

presently my 130 case says in queue and waiting to be scheduled for interview... so after it’s approved do I do another or just once

here is what my lawyer did… he filled i130 first then it got approved then he filled i485 with Uscis in a hope that my case get terminate with the immigration court ( to save time ) that was like one year ago one month ago we filled another AOS package with the immigration court two weeks ago we filled motion of termination yesterday the immigration judge terminated my case So my advice if ur i130 got approved don’t waste time and i file i485 with Uscis and file i485 with the court too with motion of termination to save time

once i130 got approved one year ago we filled motion of termination with the immigration court and dhs attorney but i got denied but these days they terminate cases so we filled the full AOS package and motion of termination so it got terminated

Congratulations @California. let us know when you get an interview for I-485. Did they ever cash your checks ? The times you filed I-485 with court and USCIS?.

When i filled i485 with uscis I took the the receipt and the biomateric and attached them with the AOS package that I sent to the court

it’s normal i had a master hearing 3 weeks ago and the judge scheduled individual hearing then he said follow the instructions to file motion of termination and if i granted it I will take off ur hearing from the system so after 12 days the judge terminated my case and took off the hearing from the system so wait one more week and check online if nothing changed then call the court to ask them if there is updates about ur motion

@california2020 i have questions please when my attorney file my case with uscis i told him am in removal proceedings we must go with immigration court even my i130 was approved but he says first we go with uscis anyhow i get work permit after 6 months when after one year interview date comes he go with uscis in february and done my medical too but when we reached at uscis for interview he told them that he is in removal proceedings so we go with court they denied my adjustment of status application in last month my work permit expired too

change ur lawyer right now why u didn’t send the AOS package to the immigration court?

if u didn’t most likely the judge will not terminate ur removal maybe he is gonna just administratively close it which is bad in ur situation

why uscis deny ur application they were supposed just administratively close it until ur case gets terminated?

right after ur i130 approved u were supposed to send the AOS package with motion of termination to the immigration court and if the motion granted and u have pending i485 or administratively closed i485 with uscis you can notify them so they can go forward to adjudicate ur case and if u didn’t file i485 or you have denied i485 with uscis then you should refile again

@california my day case was terminated on july 14. she got biometrics done july 21 and got the social and ead july 26. yesterday we received a letter stating that her i485 is administratively close. I just find it weird 🤷🏻‍♀️

@niquee Baxer did u do interview for i485 that’s what am scared of if they deny or administratively close i485 with interview so my lawyer told me we should notify uscis that the immigration judge granted the termination so they can go forward and adjudicate ur case he told either we ship the termination letter and the missing documents with a letter to explain the situation and attach them in cover letter or we ship the whole AOS package and they are gonna take the documents they need and return us the unnecessary documents or we call uscis to schedule infopass to request my file to move it to the local office so they can adjudicate it and this is what I prefered to do first so yesterday I called uscis and they asked me for some information about my case and when the judge terminated my removal then she told me that immigration officer will call u back in couple weeks to schedule infopass for u so i hope this works and if didn’t i will go for the second option to ship them the termination letter with the missing documents

@zain Chicago... you should try to ask your lawyer why he filed combo package. maybe he did it so the 130 can be approved early. cause I hear people say when you file both they respond to you faster. anyway I hear sometimes when you file 1485 wrong like in your situation. they would just deny it and take your money. they usually send you a denial explaining why ???. try and pay for a fresh application through the court. include all the work permit and all and hope you get approved and your case gets terminated. I believe once they see your approved 130 they would terminate your case.... everyone makes mistake.... I believe yiu would get approved

Max max, I am currently in the same situation. Case terminated and i485 in limbo at the RSC Texas office.. can you share if you’ve had any progress with yours and what did you do for it? I’m getting desperate.

@Re Pin I called uscis to explain the situation and they scheduled infopass for me and they told me the local office will handle ur case from here and they told me to take the termination letter with u … I went to the infopass appointment and i gave them the termination letter and I asked them to request my file so they can adjudicate it… they asked for a copy of the i130 and i485 receipt and the passport and the termination letter and they gave me a form to sign it so they can request my file…. after 3 months and 2 weeks I received interview letter for the i485 which is gonna be the end of this month

@max max we sent our application in April of last year, my case got terminated in June, I got my biometrics done in Aug and nothing since then.. this month we started bugging them and a tier two agent said my case still shows as EOIR and does not reflect the judges decision so I wonder if they didn’t receive the copy of the IJs decision along with my medical from my lawyer (who we no longer use) or they simply didn’t add it to my file/got lost. A tier two agente called and said we needed to speak with a tier three. We never received a tier three call but received an email saying we missed their call. so frustrating. we called them again and they said we need to wait another 15-30 days to speak with a tier two agent again. Not sure what to do/say for them to give me an appointment. Texas service center doesn’t really have a processing time for marriage based petitions and they don’t update anything in my online account. it still just shows as case received.. doesn’t even reflect I had my biometrics done. Any tips on what you said during your call that led to an info pass?

Did you apply for Prosecutorial Discretion before case being terminated?

@Re Pin that’s why I didn’t wanna take thar route because some lawyers adviced me that if i send documents to uscis and they didn’t ask for it, it’s usually gets lost so the best and fastest route is to schedule infopass and hand them the termination letter by urself and in a few months they are gonna get ur file ( from dhs not uscis )

@max max I just don’t know what to say to get them to give me an info pass.. they keep on saying another tier will call to then only say I “missed their call” when in fact I’ve been glued to my phone waiting.. I have a newborn baby and it’s so hard to do this and have them still say I missed it.. we’ve already spoken to a tier 2 agent who could have given us the appointment. Did you talk to the agent yourself or your lawyer? Did you straight out ask them for an info pass? last year when I first attempted an info pass they said it was only if the judge granted my green card in court. It seems I keep getting unwilling agents or just not knowledgeable ones.

@A I don’t know if the question was for me but if it was I had my case administratively closed for a few years and just had it terminated last June

here is what exactly happened with me …. I called uscis and I told them that i was in removal proceedings and the immigration judge terminated my removal proceedings so i need infopass appointment to give them the termination letter and ask them to request my file so they can adjudicate it…I waited exactly one month and I got a call from tier2, he told that ur local office will handle the case from here so am gonna schedule infopass appointment for u … I got appointment 2 days later…went to the office explained the situation again and asked me for the documents that i talked about it before and I signed a form to request my file … they told me it’s gonna take from 30 to 60 days and if I received nothing from them I schedule another infopass and come back to them … 2 months passed and I received nothing then I called uscis again I got a nice tier1 who told me ur gonna receive emergency call from 1 to 3 days because I waited one month for the first info appointment… couple hours later I received a call from tier 2 who scheduled appointment for me … couple days later went to the local office and they told me to wait another 60 days … after one month and 2 weeks I received interview appointment for the AOS

Thank you so much for sharing. I will hopefully get an info pass appointment next time I talk to them. I’m also hoping I’ll get my EAD in the meantime as I’m an ICU nurse and my current one (through another process) is going to expire in May. It seems like it took you about 5 months from the time you first called them until you had your interview scheduled. What field office do you belong to? I’m in NC. Also, what’s your priority date? I guess mine will drag on way beyond 12mo (April priority date)

@Re Pin, I’m also an ICU nurse. I have EAD through another process and it is going to expire on July. I am hoping to get one by then or I’m going to expedite. My case was in court and got terminated in April 2021 after I-130 approval. my lawyer resend AOS package and now my current PD is September 2021

My work permit and i-131 is at NBC. the i485 was sent to Texas based on the instructions online for court/EOIR but now that it’s terminated I’m trying to get it to my local field office or Chicago which is the office for my NC address. I did biometrics on Aug 31st.

@Cali Fornia, can you please help me. I called uscis about 3 times and each time I waited 30 days to hear back and they simply won’t schedule me an info pass. The officer I talked to was very rude and unwilling to hear me explain my case (in simple words) and would not give me an info pass even when I told him I had an email from from (from another inquiry) telling me to schedule an info pass to bring the judges decision. He just told me to sit and wait because my case is still within the processing time. Mind you Texas doesn’t even process marriage based gc so not sure which processing time he was looking at. The email we got clearly says The Texas accepted my case just for data entry and biometrics purposes but that after the judge terminated my case I should do an info pass. I’m at a loss with my case being in limbo and can’t get an info pass now. When I insisted the officer take a look at the email I had he said he did and he knew better than the person who wrote it. He sort of in a sarcastic way he Oh let me look at the local office schedule. oh nope, nothing available in the next two weeks, sorry! just get in line again for another 30days and call again” 😭😭

@Ren Pin ok let me explain to my case first because it maybe different from your case when the immigration judge terminated my removal I was having pending i485 with uscis for like one year so after the termination I called uscis to schedule infopass I explained the situation and asked them for infopass appointment to give the local office the termination letter and ask them to request my file so they can adjudicate it they told me to wait for like 30 days for tier 2 to call u I waited exactly 30 days and I got the call and I explained the situation again and the officer told me yeah we didn’t take a decision on ur pending i485 because u were in removal proceedings so now u r not anymore so am gonna schedule infopass appointment for u and ur local office will handle ur case from here I went to the local office and explained the situation again and they asked me for the termination letter and fill out a form to request my file and they told me to wait from 30 to 60 days to hear from them and if I didn’t i schedule another appointment two months passed and didn’t hear from them so I called uscis again to schedule infopass and they told me that u already waited one month before to schedule appointment so we are gonna give u emergency call within 3 days I got a call from tier 2 couple hours later and scheduled another infopass went the the local office and they told me to wait another 60 days 46 days later I received the i485 interview appointment

thank you. so it’s the same as mine. I don’t know why the officer who didn’t seem to know what to do didn’t allow me to explain or give me an info pass. I don’t know how else to talk to them to get an info pass. He said unless the judge granted me a green card then I don’t need info pass. And the place that has my application emailed me saying I need an info pass because they don’t process applications there. I’m at a loss 😢😭 I’m waiting for an urgent call (finally found a good agent willing to place it as urgent) tomorrow so hopefully I’ll talk to someone who understands the situation

Has anybody received any news ? My husbands case was dismissed on March 13,2022 and we received the letter so now I am making an info pass to bring the dismissal to west palm beach offices where we had our 2nd interview in 2019. We have approved i130 and we had our interview for i485 but officer said of course that he could not approve because my husband was in removal proceedings. So frustrating! We applied in 2013 and were denied. Appealed that one and no news from that appeal. Judge told us to apply again so we did. Went for interview and officer that interviewed us said he didn’t understand Why it was denied. We have been married since 2006. But lived abroad we came here for my fathers funeral and decided to stay because of my mother having Alzheimer’s and dementia. We were her caregivers, my husband having b1/b2 visa. But hired a lawyer that did not introduce papers in time. So then it was too late ICE came to collect my husband. So this is our story hopefully it is soon over!

Thank you God First ! I hope so we are so sad really as my husbands father passed away 2 years ago and he could not be with him due to removal proceedings and ICE having his passport ! We were refused info pass to uscis saying that we are in normal processing times. Could you believe this ? And his mother has complicated health issues. I am so worried that something might go amiss with her also and he will not be able to see her. We have been dealing with this since 2013 ! This is ridiculous!
