motion to reopen
I am LPR's husband. I applied in March 2024, and on May 22nd, 2025, I had interviews for both in the New York filing office. In June, I received a NOID requesting the prior marriage documentation that we had provided on June 12th, 2025, and February 25th, 2026. I received denial letters for both I-130 and I-485 yesterday. The letter states that we denied you because you did not respond in a timely manner but we completed the process on time, and I have a USPS receipt that shows USCIS picked up your package and someone signed it. I'm not sure what's going on, but I submitted to the New York filed office because they stated in the NOID LETTER that you must submit there and in the denial letter they mention about i-290B. Could someone please advise if I should file an i-290B or reapply for new i-130 and i-485? If I choose to file an i-290B, how long will it take to receive any updates after that? Or should I apply for an I-290B now and then apply for a new I-130 and I-485 in a month? Or should I contact congress man because they help me for case inquiry and after that I got decision Tell me if anyone else is experiencing the same thing, please.

I think you should go with the motion to reopen because your case was denied in error. When submiting, you should attach the usps receipt and any other document that shows that you responded on time. It will also be best to re-submit the documents that was requested in the NOID as well. Kindly contact your lawyer as well if you have one.

I would also go with a motion to reopen and reconsider because you have evidence to support their mistake, but at the same time they could take up to 2 years to adjudicate the motion and with the current administration trying to kick every immigrant out it may be risky waiting . we were also denied because my husband was deployed and could not attend the interview. we filed a motion to reopen and reconsider however that still remains pending because out field office is so incompetent. we had to refile a new case and just had our interview this past Wednesday. the motion is pending and they are ignoring it. I guess it depends on your field office and how quickly they respond. get a consultation with an attorney to best weigh your options

@ we filed the motion in November 2024 and it's still pending . field office is SLC

@ am not sure how long but I heard it takes a while depending on the field office.
