EB1-C with PD as Oct 2021 receipt date as Nov 1 2022 Case Remains Pending since Aug 2023. created many SRs and Senator inquiry. They just respond your case will be processed soon in the order received and there are large numbers of applicants with date current pending

have they stopped looking into eb1 India cases altogether? I see very few approvals

@p k . I applied for AP renewal in Feb 2024 it's 13 months now still pending. MyUSCIS progress tab shows 2 more weeks until decision. so looks like 12+ is the trend

@p k . @huber Manu Approval rates are slow that could be the only reason. Seems enough GC are available as April visa bulletin also moved date by 2 weeks.

@P N - after how much time did you raise senator inquiry?

@saurabh gupta I did in Oct 2024 so after 2 years from application filing. Date was not current in 2023 and until July 2024. but in 2024 they utilized all EB visa by mid Aug so there was no point raising then

@P N - If all the EB visas were utilized by Aug 2024, the dates should've retrogressed. Isn't it?

@saurabh gupta if earlier in FY they do but it was end of fiscal year 24 and just one month left so they didn't do. They only released a newletter mentioning visa utilized and no visa available for EB1 categories. New FY starts and quota reset from Oct 1st.

haven't seen any EB1 India approval in teackitt, reddit or in this app. my opinion is this every quarter they have quotas for row, India and China. hoping April brings in good news

@P N - But EB1 date progressed in April bulletin which means Visas are still available. There are no more visas available for EB4 though (which was notified). Do you have the link which says that all EB visas are consumed for this fiscal ?

@saurabh gupta I mentioned it was consumed for FY 24 in Aug which was last year. visas are available for this FY

it’s mentioned in the visa bulletin that if the annual limit for the visas is reached and no more visas are available they will make it as U/unavailable so definitely there are visas available

I see approvals for ROW within 4-6 months of receipt date.

approvals also happening for EB2 and EB3 India as seen on Trackit forums

EB1 for India will not move forward at least this year. As I heard all EB1 visa is consumed for this year with so many cases still pending earleir to PD Feb22. EB1 has become a joke now with no top priority

@G L that was till sept 2024. Oct to sept 2025 they should be able to approve still

@G L GCs for EB1 are available for India that's why dates moved 2 weeks to 15 Feb in April Bulletin. so they still have 6 more months to approve with available quota this year until September end. only issue is approvals happening so flow EB1 India. from past trends the approval rate increases in Last quarter (July to September) where they want to utilize all available quota

@first last not sure it's good for anonymity maybe discord could be better. though I don't see how it will help us..everyone has the data now..things are damn slow @P N mentioned

@G L I am not sure as dates don't move if there are no visa. USCIS just putes note in visa bulletin a month before as they did for EB4. the dates were holding steady and usually not all quota for EB1 is used in first 6 months. there are not many approvals as I see on many Whatsapp telegram groups Trackit etc. it's just slow and may pickup pace in last few months if FY

also @G L your case seems approved long time as mentioned on some other posts. can you share your experience here

@capa chase you must be relieved seeing April VB. this PD must have been haunting you seeing Visa bulletin each month not moving from 1st Feb 2022

@P N it was frustrating, but made peace with it as there was nothing much i could do. Hope things move fast this time.

someone I know with EB1C PD Aug 2021 from other groups received his daughter's I485 approval on March 15th. He and his wife received GC it last year but his daughters went into CRP as no more visas were available to EB1 in August end

@saurabh gupta got the GC after 8 months of receipt date.. that still within the 12.5 months maximum.. so my estimate is most people should expect GC after 6 to 8 months after receipt date.. more than that is an anomaly

Here is the timeline - PD: Apr-2020 RD: Jul-2024 Biometrics: Sep-2024 EAD Approval:Oct-2024 I485J Approval: Jan-2025 GC Approval: 17-Mar-2025 Daughter has turned 14 this year so she needs to undergo biometrics in April. Hopefully, it should be approved soon for her as well. It was bit of a back-n-forth as doctor was not aware that guideline was revised to include polio vaccine as well. So we received another RFE, which was responded and then USCIS misplaced my medical form. So another RFE was reissued. This might have impacted processing of my application.

one of my service request regarding Case outside normal processing time has been answered over email as follows. not sure if it means anything or standard response. Senator inquiry was answered last week similarly acknowledging that date is current and there is large backlog. case will be worked on the order received. SR response as follows : Recently, you notified USCIS that your priority date is current. When your priority date becomes current, your case automatically returns to active processing and will be worked in the order in which it was received. Once further action is taken, a notice will be sent to the address of record.

@huber Manu apparently nowadays Service Requests or inquiries are joke. they are not responding on time either and after 30 days they just send standard template reply

any eb1a India coc got approvals in last coupleof weeks? I see several in July and August still pending.. its almost 8 months now.

CIS Ombudsman offices closed permanently by current administration.

@huber Manu not directly. people who faced longer delays were able to reach out Ombudsman like congressman inquiry to get the attention. it helped many to get decision sooner if they exhausted all other options
