Medical RFE | EB1 C India
Hi Folks, I just received medical RFE. Interestingly, I had submitted the application concurrently along with medical docs in Jun 23 so seems they may have lost the files. Other theory is my doctor may have messed up indicating the correct response for Hepatitis B. I am yet to receive my partners RFE. Does the dependent RFE follow the primary one? I am thinking of filing each individually as I am unsure on when will we receive her RFE. I am also also thinking to not investigate this further and simply submit new medicals. PD Date: Dec 2017 i485 Filed Date: Jun 23 Application transferred from TSC to NBC in Dec 23 and got current on 1 Jan 24.

@Raj S, sorry to hear about your medical RFE. Why would you think it could have been because the doctor didn't respond correctly to HEP B? Weren't you given a copy of the sealed medical? What did the RFE exactly ask? If something is missing like HEP B, it will ask for it. Otherwise, it isn't the issue. Also, if you and your partner had submitted the medicals, your partner might not get an RFE if the package isn't lost or ..... I would advise you address yours and wait until your partner gets an RFE.

@Rijo Rijo : Not sure of the exact reason. it could be that they lost the medical while the case was being transferred to NBC

@Atharv A : Case got transferred from TSC to NBC for i485 processing. It is still at NBC, hasnt moved to FO. The RFE is also from NBC

@Raj S before moving to CRP(not current ) or Approval(if current) they validate the medical it looks something is missing in your medical that is the reason they sent RFE.

uscis often loose files but never admit it (otherwise you’ll have proves for suing them). So I guess resubmitting is the best way. And make sure that the doctor has filled everything that’s needed (ask a doctor to provide a copy of the report for your records, say that your attorney asked you to — doctors can’t refuse such request). from that copy you’ll see what’s inside of the sealed envelope and will be able to check it to ensure it’s correct
