Medical Examination Report and 90 Day Rule
Hello everyone, I would like to ask. My wife has a green card. I entered us with a tourist visa at the end of August. Now I want to submit a 485. My lawyer told me that it is not recommended to submit a medical examination report that is less than 90 days old after entering . There is a risk of being rejected.

the 90 day rule is to show that you didn’t come to the US with the intent to adjust status. the medical is irrelevant here … if you already applied for the 130 then aren’t you already showing your intent to immigrate? if your lawyer wants you to wait more than 90 days, that’s for the 485 in general. I would recommend sending the medical with the 485 so they don’t request it and have the process take longer… but you’re in for a long wait as the husband of a LPR.

double check that you’re not out of status once your tourist visa expires because if that’s the case your green card will be denied

I recommend ur fiance filing for citizens first else u in for a really really long wait..
90 rule prove as what @w s said. medical have ntn to do with it.
